Other disturbing charges alleged in the Case: Yelling, Ranting, raising fists at Barone, loud, angry and belligerent badgering, intimidation, refused to follow Court protocol, removes court documents prior to hearings
It appears that other lawsuits may be filed against Judge Tony Mallery for similar bad behavior

Lassen County Times Continues
to
Suppress the Truth About LMUD
Sam Williams, Editor of the Lassen County Times, has suppressed the truth about LMUD's corrupt business practices. He continues to do a great injustice to the public and is the NUMBER ONE ENABLER OF GOVERNMENT CORRUPTION IN LASSEN COUNTY
Williams allowed the recent 12/20/16 front page article on the Honey Lake Power/LMUD contract to be published. Honey Lake Power is in trouble and LMUD takes advantage of their crisis. LMUD convinces HLP that a 20 year contract is better than a 30 year contract by offering HLP less money and a promise to dump HLP when LMUD builds a proposed multi-million dollar substation in Wendel for NV Engery. SOUNDS LIKE A GOOD BUSINESS DEAL...............?
The LCT could report the truth, but chooses NOT TO.
LMUD has been embroiled in deceit and deceptions since LMUD'S 2001 Arrowrock Hydroelectric scandal to cover up the disappearance of $8.7 million dollars. Kan We Help has documented the LMUD Boards lies and corruption since and continues to expose LMUD's bogus projects that have cost millions of ratepayers money.
The Lassen County Times protects corruption,
Kan We Help exposes the corruption
In 2011, Williams knew that LMUD didn't purchase the ATT property (Viewland) and covered it up. This cover-up goes back to 2007 when Invenergy came to town with a promise to give LMUD $40 million dollars worth of new infrastructure. Invenergy convinced the LMUD Board to spend $40,000 for a "System Impact Study" for a 230kv transmission line. The "System Impact Study" was released at the November 26, 2013 LMUD meeting. Kan We Help requested a copy of this alleged study and was denied a copy.
LMUD signed a MOU with Invenergy on August 28,2012 that expired on February 28, 2014. This MOU was just as bogus as all Invenergy promises and the only entity spending money "on nothing" was LMUD.
At the December 23, 2013 LMUD Board meeting, the lies seem to escalate. The LMUD board revealed that they were considering signing a 15 year contract with Oski Energy (Wendel Energy Operations). This was a shell corporation based at 730 Sandhill Road, #250, Reno Nevada.
The concept of this 230 kv transmission line died a decade ago, like all of the previous years of LMUD phony projects and alleged agreements the LMUD Board has released attempting to present the 230kv transmission line as legitimate.

LMUD'S HISTORY OF SCAMS ON CONTAMINATED PROPERTIES
2004-LMUD's Richmond Road Substation
In 2004, LMUD illegally stored and transported toxic waste at their Richmond substation (420 Richmond Road, Susanville) and then forged Federal documents to move the toxic waste. The EPA fined LMUD $9,000
LMUD Director Fred Nagel & Frank Cady negotiated to buy property from their friend Jack Beterbide that Beterbide didn't even own. On January 26, 2006, Jack Beterbide purchased the Chestnut property from Robert and Gail Prosise for $120,000 and then he sold it to LMUD for $381,232 the same day. The ground on the Prosise property and Beterbide's property was heavily contaminated with years of fuel and other contaminates . LMUD relieved Beterbide and Prosise of a 20 year environmental disaster. The property was worthless and Nagel and Cady knew this.
Nagel helped his friends dump worthless property on the public
LMUD Director Jesse Urionaguena was related to Beterbide and abstained from the vote to lease the property back to Jack Beterbide and left the cost of the cleanup to the LMUD ratepayers
2007-Hayden Hill contaminated land swindle In 2007, Fred Nagel and Frank Cady set in motion a scam that would cost LMUD ratepayers hundreds of thousands of dollars in legal fees to get out of. Nagel and Cady signed a $65,000 check for worthless transmission lines that had been taken down at Kinross Gold's Hayden Hill Mine. Fred Nagel, Bill Stewart and Frank Cady concocted a swindle on the Willow Creek landowners. They promised these ranchers LMUD power if they deposited $30,000. LMUD had no intention of providing power because this was Surprise Valley Electrics district. The man that wrote this check was later found dead in his home from a gunshot wound
Fred Nagel and Bill Stewart lied to the public about purchasing the ATT property/equipment for a "Viewland Substation".
LMUD NEVER PURCHASED ANYTHING FROM ATT, BUT PLANNED TO BUILD A USELESS SUBSTATION ON THE LAND LEASED FROM BLM
ANOTHER LMUD SCAM GONE BAD..............
The only act that was legitimate was a lease with BLM for the surrounding land (40 acres). The problem: it was contaminated and could not be developed until LMUD cleaned it up. BLM was adamant about the cleanup before issuing any permits. LMUD could not afford to clean up the land without admitting they knew it was contaminated before they leased the BLM land.
LMUD has floated the lies about interest in a 230kv substation for over a decade. Developers have come and gone with big promises about paying for this 230kv substation, but because there has never been a market the "idea or concept" was just that and never went further than an "idea or concept".
Once BLM would not let LMUD move forward with their "Viewland Substation", LMUD purchased 241 acres of land in Wendel for a substation that has no value to LMUD ratepayers.
LMUD has been overcharging customers for many years to accumulate "cash" for the "Viewland Substation". Now they have over $10,000,000 in the bank and voted to take on debt to build this 230kv substation in Wendel. Why.......?
All LMUD Agendas show that "NO ACTION" was taken on this 241 acre purchase yet on November 1 LMUD recorded the purchase.......LMUD recently paid $250,000 for this land in Wendel, and has not provided one, NOT ONE, developer that is willing to pay for this boondoggle.
Fred Nagel has lied for years that no LMUD money will be used to build any 230kv substation
THIS IS ANOTHER "ARROWROCK" SCAM
BUILT ON LIES AND DECEPTION
psrec customer, fred nagel was just elected for another four years to sit on the LMUD Board
His actions do not effect him.............
December 8, 2016
LMUD VOTED TO ISSUE REVENUE BONDS TO "FINANCE" A NVENERGY 230KV VIEWLAND PROJECT WHEN LMUD HAS SAVED (by overcharging customers for years) $10,000,000 to build this
unnecssary substation
LMUD's new Viewland 230 kv substation in Wendel ?
Lassen Municipal Utility District negotiations for the original Viewland Substation [ATT property :APN 109 -010-04] first appeared on an LMUD Agenda on August 28, 2007. LMUD Frank Cady negotiated with Mickey Villella from ATT and Charles Wright from BLM.
The property was contaminated and sat on BLM property. BLM required the property to go through environmental studies before any development by LMUD. LMUD allegedly paid various companies like Invenergy and Navigant and TANC to do studies for LMUD. Thousands of dollars were spent but NO STUDIES WERE RELEASED TO THE PUBLIC. LMUD allegedly purchased this land, in September/2011, for $2500 with the intention of building a 230kv substation.
There has never been any interest by Developers for the 230kv transmission line but LMUD pursued BLM for permits to build a substation. Permits that BLM was unwilling to issue according to the LMUD Minutes.
A substation that had no use......a substation that would just sit and do nothing.
The Public was dooped once again by LMUD
Lassen County Times misled the public again.
The LCT continues to be an enabler for corruption in this County
Public documents show that LMUD lied to the public about purchasing the ATT property/equipment. LMUD only contracted a lease with BLM for the "right of way" of the 40 acres.
Did LMUD attorney Eugene Chittock continue to broker this scam or was this Frank Cady and Bill Stewart's deal? Regardless, the LMUD Board bought into it
There was no interest in the 230kv Line in 2004 when the concept was first marketed by Frank Cady and Bill Stewart and there is no market for it today.
In 2016, LMUD was unsuccessful in buying the BLM 40 acres that surrounded their contaminated ATT property. LMUD was not willing to clean the property up and lost interest in developing this substation on March 22, 2016. Talk then began on investigating a new site.
According to LMUD April 26, 2016 Minutes, Director Bowden suggested that LMUD drop the 230kv project and "concentrate on just what we need right now"
There were no discussions on developing the original Viewland substation for three months and then suddenly LMUD purchases a 241.88 acre site in Wendel for $250,000. This 230kv project was resurrected now as "two" substations to connect to NV Energy. NVEnergy will not be helping with the financing. LMUD has even paid for all of the alleged "studies".
LMUD Manager's Message: Ruralite January 2011
LMUD has been overcharging their customers for years under the guise of "more reliable power" and accumulated over $10 million dollars of unrestricted cash, and the

Supervisor Chapman says.... look the other way
while he fleeces the taxpayers JUST ONE MORE TIME
The bloviating, blistering, bafoonery of Supervisor Chapman gets one last chance to attack the Critics. Todays Lassen County weekly/advertiser gave Chapman a half page to blast his critics.
CHAPMAN HAD THE COUNTY CLERK ERASE THE 11/15/16 PUBLIC CRITICISM , WHICH IS ILLEGAL TO TAMPER OR DESTROY PUBLIC RECORDS OR PROPERTY (California Penal Code 594)
County Clerk Julie Bustamante has made it a common practice to erase Chapman's irrational tirades
Chapman did, in fact, bully the other Supervisors into giving him this Palm Springs vacation(over $3,000) this week to get "Supervisors" training at the CSAC Palm Springs Annual meeting.
Chapman retires in 32 days.
The truth: Chapman wanted to make sure his replacement David Teeter was placed on the CSAC Board of Directors and he thought the public owed him one last free vacation (he was entitled)
This Board has never respected the Brown Act, Public Records Act or any other law that requires them to be honest.
Kan We Help told Supervisor Hammond a dozen times that he could not vote on the sale of the Herlong property. He did it anyway and the FPPC fined him $2500. Would he do it again.....? You betcha. He just hopes he won't get caught.

November 15, 2016 meeting Audio CD Altered
The Public Records Act states that any audio, video or record that a public entity makes, of a pubic meeting, becomes a disclosable record to the public.
Kan We Help submitted a "Public Records Request" for a copy ($5.71) of the audio of the 11/15/16 Board of Supervisors meeting only to find that it had been altered.
The CD clearly stops at the Supervisors 11:03 AM break.
According to the 11/15/16 Minutes the meeting continued at 11:08 AM.
The Minutes also state this meeting adjourned at 12:46 PM, but the audio from 11:08 to 12:46 was deleted.
ONE HOUR AND THIRTY EIGHT MINUTES DELETED
What happened in that 1 hour and 38 minutes?
TIME: 11:08 AM
1. Milford Fire District appointment
2. Rate increase for Susan River Park Water Company
3. Chapman's appointment to the CSAC Board for 2017 (he retires in 2016; 44 days)
4. Marijuana discussion on State Proposition
TIME: 12:46 PM
[Clerk of the Board: Julie Bustamante]
Deputy Clerk of the Board, Susan Osgood, is responsible for the Board's Minutes and the Audio recordings. This was a deliberate act of altering a public document.
This is not the first time this has happened and usually occurs when Supervisor Chapman has had a temper tantrum or violated the Brown Act.
Kan We Help has requested a second complete copy of the recording of the November 15, 2016 Board of Supervisors meeting.

Lassen County Supervisor Chapman gets to go to the CSAC party ($3,000 in Palm Springs) on November 28 for one last paid vacation. Supervisor Chapman leaves office on December 31, 2016. This expense does not serve the best interests of Lassen County.
November 15, 2016 BOS Meeting Minutes
Jim Chapman: a 40 year self serving career politician
Chapman told the public that the $3,000 trip for his successor, David Teeter, was warranted because it was training for "New Supervisors". The six day trip includes only a day and a half of "training".
On October 25, 2016, BOS Chairman Chapman did not consider approving expenses for the second "New Supervisor" from District 1, but always intended to go to the CSAC party himself and bamboozled (?) the other four Supervisors to appoint him to the CSAC Board again with David Teeter as his Alternate.
....and the public would not notice that Chapman leaves office in 46 days.

Supervisors claim they may send District 1 Supervisor-elect to this 1 1/2 day training for the 6 days (?) but the deadline for registration is November 15. The Supervisors do not meet again until November 15 and if they vote to send the new District 1 Supervisor the registration cost will increase because of the Supervisors poor planning. Neither Supervisor will be a County employee until January 10, 2017 and only then are they eligible to use "public" money. NICE WAY TO START A TERM OF OFFICE?
The Supervisors could have approved sending, at the 10/25/16 BOS meeting, the District 1-elect Supervisor on this vacation but DIDN'T..........
In addition, Supervisor Jim Chapman never mentioned this when he arranged for his replacement David Teeter to attend this six day vacation back in September.
Very little of the CSAC Annual meeting, in Palm Springs, relates to new training for a new County Supervisor.
The upside: The fees do include two more training sessions (February 9 &10)

LMUD Director Fred Nagel Games the System
Nagel was elected to replace a Recalled Ward 1 LMUD Director in 2002 and quickly took advantage of the corruption that existed in LMUD.
One of Fred Nagels abuses, as a LMUD Director, is gaming the system. Nagel doesn't report any legal activity on his monthly "STATEMENT OF MEETINGS" report but secretly takes trips.
All activity that LMUD pays the Directors must be reported on these monthly statements. Nagel knew this and disregarded the law.

LMUD has overcharged customers a million dollars a year & has hoarded over $9,000,000 in "Unrestricted funds"
The current $ .13 per kwh rate should be reduced immediately to $ .11 per kwh
YOU WANT LOWER RATES?
REPLACE THE THREE LMUD INCUMBANTS
LMUD WARD 1 DIRECTOR IS ON THE NOVEMBER BALLOT AND WANTS ANOTHER FOUR YEARS?
ELECTED DURING LMUD RECALL IN 2002
De ja vu: In 2001, the LMUD Board accumulated over $8,000,000 in unrestricted funds and then allegedly speculated in the Market and then claimed they lost $8.7 million dollars. This loss was never investigated.
To avoid bankruptcy the LMUD Board proposed a 162% rate increase. This attempt to increase the rates failed so the LMUD Board with the help of their attorney, Frank Cady, came up with the fake Arrowrock hydro scam as a smoke screen.
Subsequently, four members of the LMUD Board were recalled in June of 2002. Fred Nagel was elected to replace Ward 2 Director Giannotti. County Clerk Theresa Nagel refused to place LMUD Ward 3 Director Wayne Langston (the Nagels son-in-law) on the Recall ballot. Langston was never on any LMUD ballot and never received a single vote
On October 26, 2007, LMUD Directors Nancy Cardenas, George Sargent and Darrel Wood resigned amid the corruption, abuses and mis-conduct of Frank Cady. This left Fred Nagel and his son-in-law Wayne Langston who supported Frank Cady's actions.
The remaining Directors wanted to appoint the three new LMUD Directors but the appointments were made by the Lassen County Supervisors.
In the past nine years Fred Nagel has led this Board in scams that have cost the LMUD ratepayers literally over a million dollars.
....and 17 other Nagel scams in his 14 years on the LMUD Board
Non-existent 230kv Viewland substation
LMUD has budgeted, in their 2016-2017 Budget, $7,581,597 to build a substation that will not benefit LMUD customers. The 230 kv line project has been around a long time and has never had support from anyone in the State of California but would benefit NVenergy in bringing their power to California through LMUD lines.
Fred Nagel has supported rate increases that have overcharged customers a million dollars a year for years to put into this super-fund that is UNRESTRICTED AND CAN BE SPENT FOR ANYTHING.

Unless Jim Chapman resigns and David Teeter takes the Oath of Office before October 25, David Teeter is not entitled to receive anything, including a six day vacation to Palm Springs
David Teeter will not be a County employee until January 10, 2017
Will the retiring County Counsel let this happen ?
October 21, 2016
Lassen County District 2 Supervisor Chapman will attempt to give his replacement, David Teeter
an early Christmas present:
All expense paid six day vacation to Palm Springs on November 29, 2016
Chapman submitted this expense on September 1, 2016. Teeter doesn't take office until January10,2017 and cannot receive any pay, benefits or entitlements until he is sworn in.
Chapman can do this, if four other Supervisors break the law and approve this expenditure at their 10/25/16 meeting
There will be an run-off election for District 1 Supervisor on November 8.
Where does the winner of District 1 get to go....?
David Teeter does business with Lassen County. The Supervisors will vote on this Conflict of interest for Teeter at the October 25, 2016 meeting (Agenda H-2).
If this is not approved, Lassen County can no longer do business with Teeter's business.
If approved, Teeter can continue to do business with the County and would be required to recuse himself on any vote that would effect him and his business.
NOTE: Supervisor Tom Hammond never disclosed his lucrative business with the County until Kan We Help exposed his conflict. The Supervisors then approved to continue doing business with Tom Hammonds businesses in Herlong.

NO MOVEMENT ON THE REMODEL
This old building just sits quietly
AND EMPTY
Lassen County Supervisors approved a $979,000 contract to United Building in September to remodel this 20 year old building
Lassen County CAO Richard Egan never had any inspections done prior to getting approval from the Supervisors to purchase this poorly maintained building. Now, the costs to repair and remodel exceeds the amount left of the COP Loan.
CAO Egan recently asked for a one year extension to his five year contract that terminated in 2018.
The Supervisors extended Egan's contract to 2019.
DID EGAN THREATEN TO RETIRE AND LEAVE THIS MESS FOR THE SUPERVISORS OR DID THE SUPERVISORS THREATEN TO FIRE HIM?

Stiff Lassen County
According to the Lassen County Auditor HSP has not paid this $47,996.50 invoice that was due on September 11.
Will the County place a tax lien on the Amedee Parcels ?
There were higher bids, for this contaminated property, but the Supervisors gave the 3,000 plus acres of public land to Hal Hays, Larry Smith & Steve Pezzullo (HSP Resources) because they offered to pay for the Airport Land Use Plan and they claimed they were in negotiations with Sierra Army Depot (which turned out to be a total lie).
HSP Resources nor ANY PRIVATE CARRIER can ever use the Army's Amedee Airfield. Supervisor Tom Hammond must stop telling the public that they can.
HSP RESOURCES WILL NEVER DO ANYTHING WITH THE HERLONG PROPERTIES
Now they are stiffing the taxpayers of Lassen County again
October 7, 2016
Lassen County CAO Richard Egan
suddenly leverages an extension to his Contract?
CAO's usually do this when they threaten to quit or have been threatened with termination. This additional year would be a "buy out" of more than $200,000. Egan was there to watch a previous CAO accomplish this.
Supervisor Pyle walked out and did not vote for Egan's contract extension
INCORRECT DATES IN AMENDMENT.
IS COUNTY COUNSEL OUT TO LUNCH?
Three months after the Supervisors hired Egan they had to amend his contract. For reasons yet to be explained, Egan wanted the title of CEO (Chief Executive Officer) but Lassen County only could hire a Chief Administrative Officer. Kan We Help filed many complaints, with Lassen County, that there was NO CHIEF EXECUTIVE OFFICER POSITION AND EGAN HAD TO STOP SIGNING OFFICIAL DOCUMENTS WITH THAT TITLE. Thus the need to have the May 13, 2014 Amendment.
CAO Egan's original contract expires on February 25, 2018 . Paragraph 2: Term states that Lassen County must notify Egan by February 25, 2017 if they did not intend to renew Egan's contract.
If no notification was given by February 25, 2017,
Egan's contract is
automatically extended one year.
So why do they need this second amendment ?
Egan's salary is well above $170,000 now.
When will the Supervisors sneak in a pay raise for Egan?
KAN WE HELP WILL MONITOR THIS VERY CLOSELY

Approve the 2016/2017 Budget CAO Richard Egan warned the Board that even though the County was able to locate the money (in small over-budgeted accounts) to pay for all of the requests from Department Heads for new positions and pay increases, the County could not sustain this level of expenditures Egan threatened the County Department Heads, in the audience, that there will be eliminations of positions if/when they are vacated. Kan We Help was disappointed that this annual threat was unnecessarily made. THEN....... KAN WE HELP MADE A PRESENTATION !
Kan We Help offered the evidence where Chapman and Egan placed large amounts of money in small accounts to be transferred "quietly" into personal projects of the Supervisors and their friends
Richard Egan's poor management of the $4,080,000 loan is the reason he will dip into Lassen County's Reserve Account ($1.6 million) for Chapman's elevator
September 8, 2016
The cost on Lassen County's
office "acquisition" and "improvements
is now up to $2,453,628 not the $1,700,000 told to the public
{add an additional $500,000 to move the 4 departments in}

Time to Pay
When HSP Resources (Hal Hayes, Larry Smith and Steve Pezzullo) purchased the 3,000 + acres around the Sierra Army Depot for $25,000 and they promised to pay for the Airport Land Use Plan
Kan We Help has followed HSP Resouces public land purchases since HSP Resources purchased the town of Herlong for $31,500 (435 Acres)
Kan We Help submitted a Public Records Request on August 31, 2016 for a copy of the Invoice sent to HSP Resources for the cost of the Airport Land Use Plan
and an Invoice was subsequently produced dated September 1, 2016
In August of 2011, the Army, not Sierra Army Depot, signed an Agreement with Lassen County to Lease-back the Army's Amedee Airfield for 50 years with an option of an additional 50 years.
HSP Resources will never OWN OR BE ABLE TO USE the Amedee Army Airfield in Herlong
The US Army TACOM, in Warren, Michigan, decides who lands at this Airfield not the Sierra Army Depot Commander's S T A F F.
April 11, 2015 letter from Major General Gwen Bingham to Kan We Help:
" SIAD's Public Affairs Officer, Ms. Lori McDonald, reiterated to the HSP Resources representative that the US Army could not enter into a separate partnership at the airfield with any organization"
The majority of the Amedee parcels Lassen County sold to HSP Resources are contaminated. The 2004 Remediation Plan must still be complied with.
On November 28, 2000, the Lassen County Board of Supervisors agreed to take 4788 acres of surplus Army land in Herlong. 435 Acres for the Town of Herlong
4353 Acres of hazardous munitions and ordinances surrounding the Amedee Army Airfield
2004 CEPA Remediation Report states a
$2.4 million cost to clean it up and the
liability to clean it up is with SAID
THE SUPERVISORS REFUSED TO DISCLOSE THIS IN THEIR
AUGUST 19, 2014 RFP ?
Kan We Help demanded that this contamination disclosure be included in future Request for Proposals that were publicly issued. They complied

Lassen County's Third
Riverside Building Remodel Bid
The real costs
to repair and remodel a 20 year old building,
when you failed to inspect
a building before purchasing
This is what is left of the $4,080,000 Lassen County borrowed
on June 5, 2015
The original purpose of this loan was:
to purchase the BLM Building on Riverside in Susanville
donate a million dollars to the Honey Lake Valley Community Pool
purchase/remodel/restore the Riverside building and move four County Departments into it...
AND
remodel the former Superior Court Building on Lassen Street in Susanville vacated by the State of California...........
CHAPMAN IS MOVING MONEY ( $444,000) FROM THE GENERAL FUND TO PAY FOR HIS ELEVATOR
Lassen County could re-think the use of the Administration Building (on Roop) for relocating Public Works, Planning, the Auditor and the Supervisors Board room.
Kan We Help submitted this plan to the Board of Supervisors more than two years ago. The bottom of the Administration building has been empty since the Court moved. The Auditor's space (is street level on Roop) would accommodate a Supervisors Board Room (since their offices are right down the hall) and the Auditor could move to the empty space directly below (the existing staircase gives the Auditor access to the floor above)

Supervisor Chapman Puts $444,908
in the
Courthouse Construction Account
for his elevator
Supervisor Chapman managed to put $444,908 in Fund 127 for his elevator despite the County needing every penny left of the $4 million dollar loan to renovate the Riverside property.
Where did he get this $444, 908 ?
He moved it from the $10 million General Reserve Account because there will be no $$$ left from the LCPIC loan which has been grossly mis-managed .
Richard Egan, as CAO, has authority to move money without permission from the Board or the Public. The Public will never see this money being moved into other accounts.
This $444,908 will silently & methodically find its way to Courthouse Construction (Fund 150/1501/3006119) for Chapman's elevator.
On July 8, 2014, Lassen County Board flew $$$ TRG's Harry Munyon $$$ from Palm Desert, CA to present an "alleged" "NEEDS ASSESSMENT" study. This Study was commissioned two years ago at a cost of $8,000. NEVER USED........
The County now wants to spend $250,000 (ADA Compliance Study) to tell the County what they already know but have been unwilling to FUND ANY ACTUAL ADA COMPLIANCE.

Lassen County Budget Meeting
CAO Richard Egan makes adjustments to small line items to
be able to fund the Department pay increases + Egan claims he will take a million dollars from the County's $10 million Reserve
This County has been hiding huge amounts of reserve dollars in little used accounts so it wouldn't be noticed................Kan We Help noticed
District Attorney claims that the Public Defender Department will be minimized with her new software program and suggested that no new positions be approved for the Public Defender
Video of 8/23/16 Budget Meeting
Supervisor Chapman bores the staff with 15 minutes of worthless trivia
Supervisor Chapman still managed to put $444,908 in Fund 127 for his elevator despite the County needing every penny left of the $4 million dollar loan to renovate the Riverside property.

Lassen County Spends $250,000 to be in
with the
Americans with Disability Act
....look at Fund 150 below...it already has $200,000 in it ?....
The 1973 law was intended to bring all businesses in compliance by 1981. However, the law kept being amended and made compliance impossible. Now public entities that receive Federal assistance must be in compliance before Grants are approved.
SZS Consulting Group will not bring Lassen County into compliance. For $250,000 it will identify Lassen County deficiencies (previous studies have never been utilized) and train County staff on current laws. The contract includes $25,000 for "public hearings"
The majority of Lassen County owned buildings do not comply with the ADA law
As Lassen County repaired or remodeled a few buildings they included ADA compliance in all public contracts, however the majority of County buildings have been neglected. Supervisors have been allowed to look the other way in lieu of pursuing their personal projects.
CAO Richard Egan intentionally failed to identify the "Account" line items for moving the $250,000 transfers. Where will this money really be spent?
August 23, 2016 Board of Supervisors Meeting
Agenda H-1
Supervisors approved a tentative Budget (2015/2016) until the 2016/2017 Budget could be finalized
Can we assume the "Equipment" dollars (Fund 119/Budget 1191/Account 3006200) won't be used for this "Service Contract"?
Should we assume $250,000, from Fund 119/Account 3007000, is being moved to Fund 150/Budget 1501/Account 3002300?
WHY DID EGAN HIDE THE CONTRACT, PROPOSAL AND "HOW" HE PLANNED TO PAY FOR THIS
$250,000 EXPENSE?
Fund 150/1501/3002300 has already budgeted $200,000.
The transfer could have been $50,000 !
CAO Richard Egan decided not to include the entire packet which included SZS Consulting Group's Contract and Proposal. Instead Egan included just Public Works one page letter in the Agenda
Kan We Help was told that Public Works submitted SZS Consulting Group, LLC's Proposal and Contract to Richard Egan and CAO Egan decided not to disclose this to the public.
We have obtained copies & will post the Contract & 60 page SZS Proposal

HONEY LAKE POWER
The hapless LCT showcases Honey Lake Powers imminent demise
It can't cover its' costs with low natural gas competition. LCT acts like that is the whole story.... so PG&E rather than sustain a LEGALLY REQUIRED mandate to provide Green Power....which HLP does.
Worse yet, LMUD will let it die like they let Mt. Lassen Power die and have NO source of back up power when the Deer Creek PG&E lines go down again.

Lassen County Airport Land Use Commission Approves
Amedee Army Airfield Land Use Plan
Supervisor Hammond did not recuse himself from the votes. He has two businesses in Herlong that will benefit from his vote. He also receives money from the County on his gas station in Herlong
L to R: Representative from Mead & Hunt, Lassen County Planning Gaylon Norwood, LCALUC Rep.Deborah Shockly
Lassen County Owns the Amedee Army Airfield but the Army has a 50 year lease with an option to an additional 50 years.
The US Army TACOM, in Warren, Michigan, decides who lands at this Airfield not the Sierra Army Depot Commander's Staff
Tom Hammond and the Sierra Army Depot representative Lori McDonald
continue to misrepresent private use of the Army's Airfield
April 11, 2015 letter from Major General Gwen Bingham to Kan We Help:
" SIAD's Public Affairs Officer, Ms. Lori McDonald, reiterated to the HSP Resources representative that the US Army could not enter into a separate partnership at the airfield with any organization"
Public Affairs Officer Lori McDonald and Chief of Staff Aric Manner stated that HSP could use the Amedee Airfield.........when they both were told that was not true
No representative from Sierra Army Depot attended the August 11, 2016 Vote by the Airport Commission
HSP (Hayes, Smith, Pezzullo) must now pay the County
for this $48,000 Use Plan

Lassen County Holds a Walk-through
of
for the
Third RFP
Bids due: September 1, 2016
4:00 PM @ 220 S. Roop Street, Susanville
Contractors showed up for yet another walk-though before they decide whether or not to bid on this project
Contractors continue to have the same concerns:
incomplete plans, questions unanswered and the County's $600,000 Budget
The only bid so far has been $1.4 million which the County rejected
Contractors were concerned that the Change Orders alone (for the unknowns) would exceed their original bid and of course....will Lassen County have the money to pay them
Lassen County purchased this building WITHOUT ANY INSPECTIONS
It is the County's intentions (according to the plans & specifications) to put a few fire extinguishers around the building.

Susanville Attorney Eugene Chittock
Costs LMUD Ratepayers
$341,000
for
Frivolous Lawsuit
Eugene Chittock filed a lawsuit on January 27, 2011 so that LMUD would not have to clean-up their Hayden Hill 69kv transmission lines they purchased from Kinross Gold on December 17, 2007.
THE PROBLEM FOR CHITTOCK:
LMUD filed a Notice of Exemption, so they would not be required to do the clean-up on December 23, 2009
This cheap suit filed a Motion to declare KWH a vexatious litigant on August 12, 2010 so that Kan We Help could not intervene on his intention to bilk the LMUD ratepayers. Chittock was paid $12,472 for filing this Motion.
Most *S.L.A.P.P. Motions like this are denied
*strategic lawsuit against public participation
This motion did not rise to the level of a vexatious litigant (7 or more failed lawsuits. Kan We Help filed 1 Writ of Mandate against LMUD for the Arrowrock scam), but Judge Bradbury signed it never the less. Judge Bradbury did not disclose that he was in business
with LMUD's Frank Cady.
August 6, 2016
LMUD attorney Eugene Chittock lied to the public about
the Hayden Hill History...Why... for profit $$$
Public Records disclose that LMUD Filed an alleged Exemption to clean up the Hayden Hill transmission lined on
December 23, 2009
NOT 2014
as stated by Eugene Chittock
to the Lassen County Times on July 26, 2016
This December 23, 2009 Notice of Exemption states that LMUD is not liable for the removal of transmission lines
at the Hayden Hill Gold Mine or the reclamation required by Lassen County.
So, the lawsuit Chittock filed on January 27, 2011 was not only frivolous but deceitful
$341,000 of Deceit
Chittock filed a vexatious motion against KWH to prevent any intervention
Lassen County Planning Department is the Lead Agency for the Hayden Hill Reclamation Plan & was never informed about this alleged "Notice of Exemption".
LMUD Directors posted a Bond & applied for a Use Permit with Lassen County to comply with the Reclamation Plan after purchasing the 13 miles of 69 kv transmission lines on December 17, 2007 & now the public is supposed to believe that LMUD was justified in filing a lawsuit to avoid cleaning up the Hayden Hill lines by claiming Frank Cady, LMUD's Attorney//General Manager didn't have the authority to buy it ?
Ten years later, after Kan We Help exposed this fraud in 2006, LMUD is still lying about Hayden Hill
If LMUD filed a "Notice of Exemption"
on December 23, 2009, there was no reason
for LMUD to allow Chittock
to file this lawsuit on January 27, 2011 to avoid
any clean-up
LMUD's liability ceased to exist on July 20, 2010
Ratepayers paid $341,000 for Chittock's folly
....and he is still employed by LMUD?
LMUD Director Fred Nagel was collecting thousands of dollars from Willow Creek landowners in 2006 falsely promising them LMUD would provide power to them through the Hayden Hill lines.....that LMUD did not own
LMUD does not plan to return any of the deposits
FRED NAGEL & FRANK CADY SIGNED THE $65,000 CHECK TO PURCHASE THE HAYDEN HILL 69 KV TRANSMISSION LINES ON DECEMBER 13, 2007 BUT THE PURCHASE AGREEMENT WAS NOT SIGNED UNTIL DECEMBER 17, 2007.

Lassen County's Clumsy Attempt to Right a Wrong
Lassen County Community Development Commission
Does Not Exist?
The Lassen County Supervisors tried to move money and transfer property belonging to the Lassen County Community Development Commission, WITHOUT CONVENING THIS COMMISSION.
A Commission they claimed, on March 31, 2016, DID NOT EXIST.
After Kan We Help exposed that the "Community Development Commission" did exist, the County started moving backwards to correct this deliberate oversight.
Kan We Help exposed:
1. Supervisors approved placing $50,000 in a parking lot account (Fund 588) to repay the restricted USDA Grant, hoping no one would notice. KAN WE HELP NOTICED.
2. Supervisors never intended to pay the the USDA Grant back. When Kan We Help asked for proof that this loan was re-paid the check was then written. Public records indicate that the USDA check was written on June 8, 2016
The Westwood Warehouse, under the Grant, could not be used by the Sheriff's Department without re-paying the USDA Grant. Again, the Supervisors unilaterally took this action without convening the Lassen County Community Development Commission. The Supervisors hoped that no one would notice. KAN WE HELP NOTICED
3. Supervisors moved the maintenance of the Westwood Warehouse property to Public Works due to the fact that the Sheriff's Department has no money to maintain a Sheriff Substation at the Westwood Warehouse on Birch Street.
4. On July 26, 2016, the Supervisors placed the Lassen County Community Development Commission on the Agenda. But moved the meeting to Beiber (over one hour from Susanville). Supervisor Chapman did not attend this meeting. Supervisor Albaugh Chaired the meeting. Discussion started on Agenda F Boards and Commissions before the Board of Supervisors convened as the LCCDC. After this was corrected, a question was asked about Resolution 16-2016 deeding the Westwood property to the Sheriff.
Was this an error, if it was done twice?

Lassen County's Request to Change
Big Valley Basin
Groundwater Boundaries Denied
Modoc County Formally Rejects
the
Lassen County Groundwater Boundary Change Proposal
CAO Richard Egan did not place this issue on the Agenda so Modoc County and Lassen County residents could participate in the discussions. Egan brought this issue up under the last Agenda item: Board Information. The Board was told to blame Modoc County's opposition to this boundary change.
Egan announced that Lassen County's request to expand the Big Valley Basin groundwater boundaries was denied.

honesty and integrity
DOES NOT EXIST WITH THE LASSEN COUNTY SUPERVISORS
Supervisor Jim Chapman demands dishonesty
The Board of Supervisors Agenda includes a Consent Calendar which is intended for routine items. Jim Chapman has abused this Agenda item more than any other Supervisor in the history of Lassen County.
On July 12, 2016, Jim Chapman placed two Agenda items inappropriately in the Consent Calendar.
The long term policy of complying with the Brown Act allowed the public to pull items for discussion in the Consent Calendar because the Board attempts to approve these alleged "routine" issues with one vote.
NOW, THE CONSENT CALENDAR IS JUST BEING ABUSED WITH ISSUES THAT ARE NOT by any stretch of the imagination......routine.
Agenda item G-5 was pulled by Supervisor Hammond. This issue was NOT A ROUTINE ITEM. Agenda item G-7 was pulled by Supervisor Hemphill. Agenda item G-7 was certainly NOT A ROUTINE ITEM (a vote to spend $1,000,000). A separate vote was taken on each Consent Agenda item (G-5 & G-7).
Supervisors Discussion on G-5 & G-7
The July 12, 2016 Minutes, prepared by Julie Bustamante, however reflect these Consent Calendar agenda items being moved out of the Consent Calendar into Agenda H, Department Reports.
The County Clerk refused to correct this and is complicit in the deception
Deliberate Deception
These Consent Agenda items (G-5 & G7) were deliberately moved into Agenda H (Department Reports ) in the Minutes by Chapman and Bustamante. All the Supervisors were notified about this deliberate deception and not one stood up to correct it at the July 26, 2016 meeting in Beiber. This action does not preclude Chapman's violation of Brown Act

Lassen County CAO Issues
Third Request for Proposal
for the Remodel of the
"WHITE ELEPHANT"
Absolutely no inspections were ordered by Lassen County prior to purchasing this 20 year old building.
The Lassen County CAO recommended buying this overpriced falling apart building that was never maintained for $1,300,000.
Now, the Supervisors have to repair this building that will end up costing over a $1,000,000. In the meantime it just sits there.......
Kan We Help will watch every penny
The Supervisors rejected the bid because they don't have the money.
CAO Richard Egan suggests that the work be bid out in piece work and the County will be the General Contractor. The problem with this is Lassen County does not have ANY PERSONNEL WITH THE SKILLS TO DO THIS. Also, Egan believes that it will be harder to track the money they spend.
GUARANTEED:
this decision will end up costing the taxpayers double and will delay occupancy until 2017.
July 26, 2016
Julie Bustamante's Agenda Deception
Lassen County Clerk, Julie Bustamante
All Lassen County Supervisors have been notified that County Clerk, Julie Bustamante, intends to falsify the July 12, 2016 Board of Supervisors Meeting Minutes.
July 12, 2016 Consent Calendar
Bustamante's Minutes reflect that these Consent Calendar Agenda Items have been placed in "Department Reports".
Next, will Bustamante add agenda items that don't even exist ?
Will her next attempt be to add Agenda items to Minutes that were never even on any Agenda

Richard Egan claimed that the Community Development Commission was dissolved

The Lassen County Supervisors are Cowards in the worst way
They put the SEIU Unfair Labor Practice Complaint issue in "Closed Session" and then take their show out of town to Beiber on July 26, 2016
On April 13, 2016, a SEIU representative asked in Public Comment the Fund & Budget their members are paid from. The Supervisors refused to disclose that very "public information"
On July 12, 2016, a SEIU representative again asked in PUBLIC COMMENT for the Supervisors to get involved. The County has refused to recognize the SEIU Labor Union. The Union is asking for a $ .50 raise for these in-home care givers.
Chapman attempts to belittle this presentation as inappropriate

Cindy Vonseca, from SEIU, Local 2015, is a member of a 300,000 member Union that represents long term health care workers. These workers help seniors and the disabled stay in their homes.
The Union wants a $.50 raise and Lassen County refuses to recognize the Union workers and will not bargain with their Union.
When Lassen County refused to give the Sheriff's Deputies a raise and pushed them almost to a Strike, Chapman never said a word when all of the Deputies came before the Board in "PUBLIC COMMENT" to protest
Listen to how Supervisor Chapman treats the people that help our seniors and disabled.
Where is the shame, Mr. Chapman, when these same people helped your own father?
Think about this Mr. Chapman: Some day they will be emptying your bed pan...............
Chapman cancelled the July 19 Board of Supervisors meeting and moved the next one 60 miles out of Susanville
You can run Mr. Chapman
but you can't hide
July 22, 2016
Bustamante Just Doesn't Care
The regularly scheduled July 19, 2016 Board of Supervisors meeting was cancelled. But still no Notice to the public on the Supervisors website recording this canceled meeting.
What a tangled web we weave when first
we practice to deceive
The regularly scheduled July 26, 2016 Board of Supervisors
meeting has suddenly become a
"SPECIAL" meeting in Bieber ?
Kan We Help has informed the County Clerk that Agenda Item G-2, in the 7/26/16 Consent Calendar, fails to report, in the July 12, 2016 Minutes, that Consent Calendar G-5 and G-7 were pulled by Supervisors for discussion and had a separate vote. Instead, the County Clerk has placed these two items incorrectly in "Department Reports"
(Agenda G, Consent Calendar, illegally prohibits the public from pulling any of the Consent Calendar items for discussion; Brown Act Violation 54954.3)

HAYDEN HILL PROPERTY WAS A
FRAUD FROM DAY ONE
Nagel, Stewart and Cady were fraudulently taking $30,000 checks from individuals that were told they were going to get LMUD POWER.
Fred Nagel knew before he took money from the Willow Creek landowners that LMUD could never provide power to Willow Creek [ Willow Creek was not in LMUD's territory]
LMUD Director Fred Nagel & the LMUD Board, Frank Cady and Bill Stewart purchased the contaminated Hayden Hill Gold Mine. This land purchase was outside LMUD's Territory (Surprise Valley Electric territory). Nagel/Cady and Stewart then concocted this scam of selling power to area land owners for a fee of $30,000.
This person was found dead, from a gunshot, in his home in Southern California
The owners, Kinross Gold, were required to remove their power lines and restore the land when the mine was closed, but sold this HUGE LIABILITY to the scam artists. Surprise Valley Electric Cooperative, who supplied the power to the gold mine, told LMUD they would not be involved.
LMUD Attorney Eugene Chittock advised the LMUD Board to file a lawsuit against Kinross Gold to dump the property back to Kinross Gold.
The lawsuit failed and cost the LMUD ratepayers hundreds of thousands of dollars in legal fees and LMUD still owns this BOONDOGGLE.

In 2015, the Lassen County Supervisors approved a contract to Lionakis to do a "study" on installing an elevator at the old courthouse on Lassen Street for Supervisor Chapman's new Boardroom.
Chapman pushed for his new Board room to be completed before he leaves office in December/2016.
Kan We Help reminded the Supervisors over and over that no money was budgeted for this and the Supervisors should concentrate on finishing the 20 year old recently acquired 2950 Riverside.
But the Supervisors approved the Lionakis $133,000 contract anyway, but never paid Lionakis.
Public Records show that Lionakis was finally paid $62,682.50 on June 16, 2016.
The taxpayers received a $62,682.50 "slideshow" presentation
One Bid was received for the remodel of 2950 Riverside: $1,433,709

The Joint Powers Authority, HLVRA,
Wants the $80,000 Annual Payment
from Lassen County
for the
Community Pool by August
THE COUNTY DOES NOT HAVE IT
According to Lassen County CAO Richard Egan, the HLVRA has asked Lassen County to pay the annual payment early in August.
However, the original conditions have changed since the Lassen County Supervisors voted to take out a $4,080,000 loan to build the new pool and purchase a building.
The Supervisors grossly deceived the public about the use of the "loan" and now have no money to pay the $80,000 this year or future years for annual maintenance support for Community pool (yet to be completed)
.....or remodel their new Riverside building..........
When Kan We Help asked what the annual payment would be, on the loan, the Supervisors refused to disclose the amount. This payment is due on June 4 of each year until 2035.
According to Lassen County CAO Richard Egan, the HLVRA has now asked, for the Supervisors, to pay the annual payment early in August of 2016.
The original conditions have changed since the Lassen County Supervisors voted to take out a $4,080,000 loan to build the new pool and purchase a building. The Supervisors can no longer use the Fund 169/Tobacco Settlement Fund to pay for the HLVRA annual payments.
THE FIRST PAYMENT WAS JUST MADE ON THIS LOAN
This annual $300,000 loan payment
will take
all of the Tobacco Settlement Fund each year
The Supervisors told the public the County's annual HLVRA support payment would be paid from the Tobacco Settlement Fund. There is no money left in this Fund

Lassen County Supervisors Hide
the
$1,359,015 Bid
to Remodel the Riverside Building
in the Consent Calendar (this Agenda item is "illegally" not available to the public)
There is less than $1,317,290.64 left of the Certificate of Participation loan
Kan We Help warned the Supervisors
many times about the cost to remodel 2950 Riverside
Purchase Price: $1,300,000 (assessed @ $1,000,000)
Remodel cost: $ 1,433,709 (bid does not include a Fire Protection System)
Supervisor Chapman continued to push for his elevator which wasted $133,000 of this loan.
After 7 months, "Lionakis" has never been paid.
Chapman hired this firm for $133,000 to do a study on putting an elevator in the old courthouse on Lassen.

Kan We Help Submits Comments and Concerns
to the
Lassen County Airport Land Use Commission
on Amedee Army Airfield
July 7, 2016: Last day for public Comments to be submitted
Public Hearing for Vote: August 11, 2016
July 1, 2016
Lassen County Airport Land Use Commission
Attempted to Meet @1:30 PM, on June 30, but
Only Three Commissioners of the Seven
Showed Up for the 1:30 PM Publicly Noticed Meeting:
a quorum is four
THIS $50,000 PLAN IS FOR "ONE" OWNER, STEVE PEZZULLO
Lassen County Planning Department Staff member Gaylon Norwood called the two Lassen County Supervisors on this Commission, District 1 Supervisor Bob Pyle and District 5 Supervisor Tom Hammond. Norwood was unable to reach Supervisor Pyle. When Supervisor Hammond was reached he claimed that he had forgotten about the meeting.
The "public comment" period for the Amedee Army Airport Land Use Plan ends on July 7, 2016.
NORWOOD CLAIMED THAT THIS PUBLIC MEETING
WAS NOT REQUIRED AND WOULD NOT BE RESCHEDULED
Supervisor Hammond showed up at 2:15 PM and the meeting was convened.
Kan We Help Secretary Eileen Spencer asked the Commissioners to look at Section 2.2.2 This section would allow major land uses such as residential development (2.2.2 (g)) within the 2.8 mile Area of Influence of the Commission.
Any of the actions listed in Section 2.2.2 would need to be reviewed by the ALUC (Area Land Use Commission), however Supervisor Hammond asked that Section 2.3 be removed in its' entirety.
Sierra Army Depot representatives were present and told the Commissioners that they would be open to sharing the Army's airfield.
Of course, this was a
total lie
and they both knew it.
The Lassen County Supervisors attempted to include the East end of the Army's Airfield in the RFP but the Supervisors were stopped when Kan We Help exposed this.
Lassen County was given the Army's Airfield and surrounding land (over 3,000 acres) in the 2002 Army Agreement with the stipulation that the Army would have a 50 year lease on the Airfield (with a 50 year additional option).
The County had every intention to include the East end of the Airfield in the sale to Steve Pezzullo.
The County then intended to transfer the 50 year Lease to Pezzullo. It failed because it was discovered in time to create a new parcel number for the East End of the Airfield and exclude the Airfield from the final documents.
NOTE:
The two Sierra Army Depot representatives below met secretly with Steve Pezzullo and Supervisor Hammond during the "public bidding" process for the Amedee Parcels.
This of course was unethical and should have excluded Pezzullo from bidding........
Steve Pezzullo included these meetings in his proposal to state that he was in negotiations with the Army and claimed he could use the Army's Airfield for any business that he would develop next to the airstrip.
If adopted, this Land Use Plan would also allow
daily Army aircraft landings
from 2 to 20 in Herlong
Lassen County Pays Off RBEG Grant
Allowing the Sheriff's Department
to
Open a Westwood Substation
Lassen County Supervisors voted to close the "Business Parks" in Westwood and Bieber and transfer the maintenance of these buildings to Public Works.
The Lassen County Auditor announced that Fund 588 would be closed and the remaining balance of approximately $20,000 would be transferred to the "General Fund". These funds are RESTRICTED and cannot be placed for general use, but they did it anyway?
In 2015 and again in March of 2016, Kan We Help challenged the $50,000 suddenly being placed in Fund 588. It appeared the Supervisors never intended to convene the Community Development Commission to legally take any action on the Westwood property. After Kan We Help challenged this action again, a check for $50,000 was sent to USDA to repay the Grant on June 9, 2016.
This warehouse, in Westwood, can now be used by Lassen County unrestricted.
Kan We Help suggests the remaining funds that were moved to the GENERAL FUND be used to move the Sheriff into this building............ASAP

BECAUSE
THERE IS NO MONEY
NOW, THERE IS NOT ENOUGH MONEY LEFT
TO EVEN REPAIR THE RIVERSIDE BUILDING
Lassen County CAO Richard Egan paid too much for this old building knowing that it had major repairs. Egan told the Supervisors that he could buy and improve this building for $1,700,000.
The building was appraised at $1,000,000. Egan paid $1,300,000 and told the Supervisors that it would cost $700,000 to repair. The only bid on the repairs was $1,433,709
This does not include the cost of a "fire protection" system

Lassen County Budget Talks Begin
Kan We Help will be providing video & the Minutes of this "public" Meeting
The purpose of the initial Budget meeting (with a very somber County Administrative Officer Richard Egan who arrived late) was to look at new County positions and/or reclassification of employees for pay increases
Undersheriff John Mineau made the presentation for Sheriff Dean Growden who was not present. Mineau made it perfectly clear the Department needs to change if they want to keep staff. He stated that if a Deputy is promoted to Sergeant they would lose $100 in pay.
THAT'S JUST NOT RIGHT
Also, CAO Richard Egan announced that yet another Veterans Affairs Representative will be leaving.
Future meetings will be determined at the 6/21/16 Board of Supervisors meeting

5/24/16 BOS Agenda Item H-4 : Capital Improvement Updates
The Supervisors finally realize there is not enough money [from the $4.3 million loan] left to finish the Riverside property and Chapman's court elevator.
Kan We Help has been critical of this Board slipping in Chapman's elevator when the County has not moved an inch in finishing the Riverside building that will house the District Attorney, Public Defender, Child Support Services and Probation departments.
Some are saying Chapman plans to cut the Sheriff's 2016/2017 Budget to fund his Elevator?
The court elevator project "has not been fast-tracked" as Supervisor Chapman wanted but is now projected to begin construction in February 2017. Chapman wanted it done so he could "historically" claim to be the first Board of Supervisor Chairperson to have his PHOTO taken in his elevator.

On May 17, 2016, District 1 Supervisor candidates Alex DeMartimprey and Paul Statti attended the question/answer forum hosted by Gail Brown of the Westwood Chamber of Commerce.
Alex DeMartimprey is a lifetime resident of Lassen County. His father was a Board of Supervisor Chairperson in 1989. DeMartimprey knows Lassen County and what the County needs, HONESTY, JOBS, HONESTY!
Paul Statti wears a Tea Party dog collar that is connected to the racist Tea Party/State of Jefferson leader where ever he goes. Statti who has demonstrated no aptitude for any elected position is representing the Tea Party and the State of Jefferson. Statti told the Westwood people, on May 17, 2016, that he has attended BOS meetings for over three years. Army's Amedee Airfield
which they have no control over
This new Ordinance goes into effect in 30 days and was enacted to allow Steve Pezzullo and friends (aka HSP Resources) to develop within the 2.8 miles of the Army's Herlong Airfield.
District 4 Supervisor Hammond continues to lie to his constituents that the Army's Airport in Herlong will be a "PUBLIC AIRPORT". The Army has a 50 year lease with Lassen County with an option of an additional 50 years (the lease was a condition of the transfer of Army land to the County)
Steve Pezzullo & friends have done absolutely nothing for the town of Herlong that they bought for $31,500 (and is selling off parcel by parcel) from Lassen County and the 3,000 acres of contaminated public land for $25,000.
Pezzullo now only has to deal with securing "permits" from the Lassen County Planning Department and wait for the inevitable approval of the poorly written "Amedee Army Airfield Land Use Compatibility Plan" that has no enforcement capability whatsoever.
This so-called "Plan" does not address Federal Aviation restrictions for military airports but makes considerations as if it was a "public" airport

THE MESSAGE THE COUNTY CLERK AND DISTRICT ATTORNEY ARE SENDING:
LIE, LIE, LIE
Public Officials Abuse
"Unchecked"
in
Lassen County
The public cannot expect the Supervisors to "police" themselves.
There is no incentive to do that.
The Lassen County Board of Supervisors each trade votes to accomplish personal agendas. Overlooking abuses of other Supervisors so they will overlook their abuses. A Quid Pro Quo, within the Board, has existed for a very long time. A practice that has become so accepted that new Supervisors coming in will believe that it is legal and moral to "help yourself".
Violations of ethics such as conflicts of interest, violating Board policies when it expedites a Supervisors effort to help a friend or just for personal gains is a standard on this Board, violating the Brown Act as though the law was non-existent and unenforceable.
Chapman's recent actions, as Chairperson of the Board of Supervisors, has become an accepted practice even though it is illegal and unethical. Some Chairpersons have chosen to go the straight an narrow and follow the law and practice honesty.
CHAPMAN HAS NOT
The Brown Act allows for the public to comment on "any" Agenda item. The Lassen County Supervsors have had a long standing policy, in compliance with the Brown Act, to allow the public to pull "Consent Calendar" agenda items for discussion. The Supervisors changed this so they can hide issues and act on them inappropriately and illegally
March 22, 2016, Consent Calendar Agenda G-2
Chapman placed this item in the Consent Calendar so that the public could not comment. Fund 150-1501 did not have sufficient funds to pay for this work and would have required a 4/5 vote to increase this budget item.
If you place it in the Consent Calendar the public cannot comment that there isn't $189,792 in that Budget and that there is only $150,000 in the Susanville Memorial Building.
THE DECEPTION:
NO PUBLIC COMMENT WAS ALLOWED AND NO 4/5 VOTE LANGUAGE WAS INCLUDED IN THE "ACTION REQUESTED" DESCRIPTION. WHERE WILL THEY GET THE EXTRA $50,000 ?
April 12, 2016, Closed Session abuse
County Counsel, Bob Burns, placed a $2,233.09 Settlement check from an Illinois class action lawsuit (which Lassen County was not a party to but simply benefited from) in Closed Session. This issue did not remotely fall under the Brown Act requirements for a Closed Session issue.
THE DECEPTION:
This was not a closed session item, so what did the Supervisors discuss? This was a regular agenda item. The public was not afforded the right to comment.
Bob Burns announced that the Board left it up to him whether to deposit the check or send it back?
THAT IS NOT HIS JOB..............
April 12, 2016, "Consent Calendar" Agenda G-218 Consent Calendar items
Supervisor Chapman placed this item in the "Consent Calendar" to approve funding for the future 2016/2017 Budget ? This would have required a 4/5 vote by the Board and was not an item to hide in the Consent Calendar. Supervisor Hemphill did not recuse himself from this vote (Craig Hemphill receives this money).
THE DECEPTION:
THE PUBLIC WAS NOT ALLOWED TO PULL THIS ITEM AND NO SUPERVISORS PULLED IT FOR DISCUSSION. THIS WAS NOT AN ISSUE TO BE PLACED IN THE CONSENT CALENDAR.
CRAIG HEMPHILL'S $79,117 2015/2016 CONTRACT EXPIRED ON JUNE 30, 2016 AND THIS ACTION EFFECTED THE 2016/2017 BUDGET.
CRAIG HEMPHILLS PAY INCREASE WAS SLIPPED INTO THE CONSENT CALENDAR AND IS NOT "Routine in nature"
Are the Supervisors now obligated to fund this in 2016/2017 fiscal year? Sleazy way to "pre-fund" your budget?
April 12, 2016, "Consent Calendar" Agenda G-8
Approving a future Budget item expense not "ROUTINE IN NATURE". Bob Burns placed a 2016/2017 expenditure in the "Consent Calendar". This was not pulled by any Supervisor for discussion. The public was not afforded an opportunity to comment on Agenda item G-8
THE DECEPTION:
THE PUBLIC WAS NOT ALLOWED TO PULL THIS ITEM AND NO SUPERVISORS PULLED IT FOR DISCUSSION. THIS WAS NOT AN ISSUE TO BE PLACED IN THE CONSENT CALENDAR. THIS ACTION PROVOKES SECRECY AND ELIMINATES ANY SCRUTINY BY THE PUBLIC.
April 19, 2016, "Consent Calendar" G-4
This Agenda items was one of those shady "land deals" Lassen County Supervisors are so famous for.
Previous Pezzullo deals resulted in giving him thousands of acres of public land for $56,500 and "Town Center" rezoning for property around Pezzullo's Herlong property and the One Stop building in Herlong which he gave back because he couldn't sell it
This was not a "Consent Calendar" issue and was placed in the Consent Calendar to avoid public scrutiny.
The public was not allowed to comment on this and now we know why?
The Supervisors intentionally did not use the Valceschini/Cramer name in the Agenda description. This was not a "ROUTINE IN NATURE" issue. The Valceschini/Cramer family built a house on the 142 acres ten years ago and now, because of the restrictions on the 142 acre parcel, could not carve out another 5 acre "residential" parcel for ten (10) years.
However, the Cramer's are developing the "Cramer Ranch Estates" between these two parcels, in which they plan to sell residential lots. What does Pezzullo or Larry Smith Realty have to do with this? Steve Pezzullo attended this meeting and left after Supervisor Chapman refused any public comment on this "Consent Calendar" agenda item .
SIGNED, SEALED AND DELIVERED
April 19, 2016, "Consent Calendar" G-6
More public money for a study of Supervisor Chapman's "elevator" was placed in the Consent Calendar to avoid any public comment.
THE DECEPTION:
The Supervisors did not place any money, for any renovations to the Courthouse, in the 2015/2016 Budget because they intended to purchase and remodel the building at 2950 Riverside in Susanville ($1.3million dollars for the old BLM building).
Lassen County CAO Richard Egan decided not to do an "inspection" prior to the purchase. Did he know that if he disclosed the terrible condition of this building the Supervisors would not purchase it ?
When the Supervisors borrowed $4 million dollars they told the public that they were going to use the money for the Community pool, purchase the old BLM building and remodel the Courthouse and Administration buildings.
With only $1.273 million remaining of the loan and the Supervisors have no idea the costs of finishing their newly acquired 2950 Riverside building, why
IS THE NEW BOARD ROOM AND "ELEVATOR" BEING FAST TRACKED OVER ALL OTHER CAPITAL PROJECTS?
YES, FOR ONE MAN'S EGO
This remodel of the old Courthouse's new elevator and Board of Supervisors new Board room is estimated to cost $1,000,000 according to Lionakis's report to the Board of Stupervisors
The so-called Chapman's Courthouse Square Modernization Committee never met and was disbanded in January of 2016.
Who did they meet with on December 1, 2015.....Chapman?

Kan We Help Challenges
Supervisor Chapman's
Abuse
of the Consent Calendar
Chapman can rely on the fact that the Lassen County Times does not report on the Board violating the Brown Act and has suppressed all of the Board's abuses. From Larry Wosick not living in his District to Tom Hammond's conflict of interests.
KAN WE HELP CONTINUES TO EXPOSE IT ALL
The Lassen County Times suppressed the LMUD abuses for 16 years:
the Hayden Hill land scam, Arrowrock Hydro Scam, Misappropriation of public funds, conflicts of interest
Lassen County Times the biggest enabler of corruption in Lassen County
An old career politician has reduced public meetings
to abuse, intimidation & personal agendas
Most politicians want their final term to be dignified, at least with a certain level of dignity anyway.
Chapman will not accomplish this.
He has reduced the Lassen County Board of Supervisors to a "bully" pulpit. The public is more than aware of his rudeness and temper tantrums.
Will the four other Supervisors rein in Chapman's style of rudeness or will they just sit back and be told what to do? Where's the representation for the other four Districts?
Chapman believes that the
PUBLIC'S MONEY is his to waste
Lassen County Supervisor Jim Chapman
Abuses Authority as Chairperson
At the March 22, 2016 meeting, Chapman threatened a member of the public when they requested to speak on an agenda item.
Chapman refuses to let the public comment on the Consent Calendar Agenda, claiming that it is "administrative" only
*At the April 12, 2016 meeting, Chapman puts 18 of the 27 Agenda items in the Consent Calendar. 8 of the 18 were pulled for discussion by the other Supervisors. So much for routine.
*The Consent Calendar issues are supposed to be "routine in nature", but that is the last thing these "untouchables" are. The Consent Calendar is approved with one sweeping vote and Chapman, unlike Supervisor Pyle, will not allow any item to be pulled for a separate vote and discussion by the public.
At the upcoming April 19, 2016 meeting, Supervisor Chapman has placed
8 of the 12 Agenda items in the "Consent Calendar".
Consent Calendar Agenda item G-6
MORE MONEY FOR CHAPMAN'S ELEVATOR
A LOT MORE MONEY !
Chapman paid $81,100 for a Slide show about his elevator?
Now, he has put an additional $ 132,505 for more discussions on his elevator in the "Consent Calendar".
When money is no object, why not
Presently this historic old staircase takes you to the second floor
Old Courthouse on Lassen Street in Susanville, CA
WHEN MONEY IS NOT A CONCERN
NO PROGRESS ON THE REMODEL
OF THE $1.3 MILLION DOLLAR
2950 RIVERSIDE BUILDING.
CHAPMAN'S ELEVATOR NOW TAKES PRIORITY OVER ALL COUNTY CAPITAL IMPROVEMENTS
The "Lassen County Scoop"
discloses that
County Counsel Bob Burns
is so............ far out of his element
Former Lassen County District Attorney and now County Counsel Bob Burns placed a California Settlement Case illegally in Closed Session. Burns claimed that this case was an "existing" case but in fact it was a copy of a Final "Settlement" Notice.
Lassen County was never a part of this lawsuit but benefited from this Class Action lawsuit.
Bob Burns didn't know the difference...........
This case does not remotely fall within Government Code Section 54956.9 of the Brown Act. This lawsuit simply reflected a "final decision" by an Illinois Court.
This was an issue that should have appeared on the Regular Agenda or they could have hidden it in the "Consent Agenda".
Brown Act Section 54954.5 (a) allows for "existing" litigation to be placed in "CLOSED SESSION" if it would jeopardize service of process or settlement negotiations.
Burns took this issue into Closed Session for a $2,233.09 settlement check Lassen County received on a settlement received from the State of California. All that was required was for the Board of Supervisors to accept/reject this money.
This was an Open Session issue and Burns did not know that ?
Settlement documents are discloseable and must be discussed in Open Session. Burns did disclose the Settlement documents from his illegal Closed Session but violated the Brown Act by stupidly placing this in Closed Session.
FYI: No excuses can be made that he no longer had an Assistant. [Attorney Stephanie Skeen is no longer in his Department. Ms. Skeen was moved to the District Attorney's office permanently.
ALSO:
A member of the SEIU (Service Employees International Union) asked the Board of Supervisors, in Public Comment, what Budget their contract is paid from. Bob Burns interrupted and advised the Chairperson not to answer?
THE BUDGET IS A PUBLIC DOCUMENT
KAN WE HELP BROKE THIS LMUD STORY IN 2006
....while the
Lassen County Times buried the
LMUD-Hayden Hill story year after year
...and now takes their "front page" story, today, from the archives of Kan We Help.
Local Attorney Eugene Chittock convinced the LMUD Board to file a frivolous lawsuit over land the Board purchased.
LMUD Director Fred Nagel is the remaining Board member that signed off on this worthless land deal
FRAUD FROM DAY ONE
Nagel, Stewart and Cady were fraudulently taking $30,000 checks from individuals that were told they were going to get POWER.
Fred Nagel knew before he took money from the Willow Creek landowners that LMUD could never provide power to Willow Creek [ Willow Creek was not in LMUD's territory]
[ The Lassen County Times suppressed all facts relating to this Scam]
Lassen County Supervisor Jim Chapman Places
18 of the 27
April 12, 2016 Agenda Items
in the
Consent Calendar
Chapman will not let the public directly comment on these 18 Agenda items, which is against the law
Also:
Chapman skips putting the March 15 Meeting Minutes on the Agenda & instead places the March 22, 2016 Minutes in the Consent Calendar even though the record of the meeting was destroyed.
No mention, in these contrived Minutes,
of Chapman's "tantrum
The Audio of this meeting was destroyed so that Jim Chapman's threats to arrest a member of the public would be hidden. However, anticipating shenanigans, Kan We Help taped the meeting.
ALSO:
Bob Burns is allowed to place a "Settlement" case in closed session. This is an Open Session Agenda item. If the Supervisors would ever hire a competent attorney, this would never happen.

"Chapman walks out of pool meeting ?"
.....Sam Williams failed to mention a few people walked out before Chapman when it became too painful to listen to the perpetual circle of the sad, sad, discussion
Williams writes that there are "nattering naysayers" against the pool project.
No....there were no "nattering naysayers" at the March 29, 2016 Pool meeting. Whenever Chapman is challenged for his lack of knowledge, he goes into his RANT AND POUNDS THE TABLE about all those people that don't want the pool & attempts to look like the "CHAMPION" of the HLVRA........ That he is NOT !!!!!
There was a very supportive group, at the March 29, 2016 HLVRA meeting, that want this community pool and has supported this project for 2 1/2 years of fumbling and bumbling from five men that have no idea what they are doing
What this so-called "Editor" omits is that Chapman leads this Board in delays and ignorance. In 2014, Chapman barely attended the meetings.
The bad decisions, of a clueless HLVRA Board, is beyond frustrating.
The real problem:
The HLVRA Board has no idea what they are doing.
L to R: Dave Meserve, Supervisor Tom Hammond, Susanville Councilperson Brian Wilson, Susanville Councilperson Nick McBride and Supervisor Jim Chapman
The "original" schedule:
JEFF HEMPHILL

Supervisor Jeff Hemphill either
committed perjury on January 29, 2015
or
profited

Lassen County Supervisor Jeff Hemphill submitted his 2014-700 form on January 29, 2015. It consisted of two sheets
Lassen County Supervisor Jeff Hemphill submitted his 2015-700 form on March 29, 2016. It consisted of SIX sheets.
In the past 12 months, Supervisor Hemphill was able to secure a job for his wife at the Sierra Army Depot.
Supervisor Chapman Pushing Contractor
to Have His New Boardroom Finished
by *December of this year
*the original scheduled completion date was 3/21/17
Chapman has spent thousands of taxpayers dollars on many studies over the years [over $200,000] to have a new Boardroom. Presently, the Board meets at 707 Nevada Street.
This location does not have an elevator.
Chapman needs an elevator.
So Chapman pressured the other four to spend $ 65,000 for another study on just the "elevator"...........
The study Chapman doesn't want to talk about was the study done in 2014. It put the cost of moving the Supervisors and staff to a new location (the old courthouse on Lassen Street in Susanville) from $862,500 to $1,425,000.
After 8 months, the Supervisors have not remodeled the offices for the District Attorney, Public Defender, Child Support Services and Probation in the old BLM building on Riverside.
Keep in mind that the Supervisors are going to use the same pot-of-money.
More than $800,000 for the BLM building and more than a $1,000,000 for the Board's new digs
???????????
There is $1,273,496.65 left of the Certificate of Participation loan and the Supervisors still are not even close to moving the four County Departments into the $1,300,000 building .
THE SUPERVISORS COULD MOVE THE AUDITOR TO THE EMPTY OFFICES BELOW IN THE ADMINISTRATION BUILDING AND REMODEL THE AUDITORS SPACE FOR THE NEW BOARDROOM, LEAVING STAFF WHERE THEY ARE.
........OOOPS, THAT IS TOO LOGICAL AND PRACTICAL & WOULD SAVE MONEY......
SCRAP THAT IDEA

LASSEN COUNTY DOES NOT NEED TO ELECT
MORE BULLIES OR LIARS
On March 27, 2016, Chris Montgomery's Mother, Dava Montgomery, sent a very disturbing letter to Kan We Help in which she threatens Eileen Spencer and her family ?
On March 11, 2016, when Chris Montgomery filed his Candidate papers to run for District 2 Supervisor, he lived in District 3, at 710-075 Sunnyside Road, Janesville, CA
NOTE: There is no public record of Chris Montgomery purchasing any property in January, February or March of 2016. Chris Montgomery lived at 710-075 Sunnyside Road, Janesville, CA (District 3)
As of March 21, 2016, Steve Pezzullo owned 250 S. Pine Street, Susanville, Ca. Chris Montgomery, under penalty of perjury, stated that he lived at 250 S. Pine Street, Susanville, CA

Could they ever trust them?
463-475 Birch Street, Westwood
This property is owned by the Lassen County Community Development Commission.
This Commission never convened.
Members:
Jim Chapman, Tom Hammond, Jeff Hemphill, Aaron Albaugh, Bob Pyle
It would have been easy just to put this on the Agenda under "Boards and Commissions" and approve the change of use. Public Records indicate the Lassen County Supervisors NEVER MET to change the use of the Westwood Warehouse.
The public was told that only the "parking lot" was owned by the LCCDC
LIES AND MORE LIES
In 2015, the Supervisors intentionally placed $50,000 in an innocuous "paving" fund to secretly pay back the USDA Grant that limited the use of this property. Chapman was on the Budget Committee that made this decision.
This "use" could not be for County boat storage.
NOTE:
The Supervisors cannot blame this deception on the Auditor, Public Works, Planning, the Sheriff.

After 2 1/2 years, the JPA Board is again bogged down in deciding on Pool A, B or C.
FLOOR PLAN OF POOL HOUSE
The JPA Board ignored the advice years ago to get the pool design completed, working drawings completed, budgets completed and when the cost was known........GET THE MONEY YOU NEED AND HIRE A CONTRACTOR.
Of course that was not done and now they are bogged down again with Option A, B, or C. Empathy goes out to the General Contractor to have to put up with this Board.
Project Manager Jared Hancock suggested that the Board might want to allocate more money?

This JPA Board did not listen to anyone and the fact that they had zero experience or knowledge of building anything is why the pool has not even started construction
After Jim Chapman threw yet another one of his tantrums and had a meltdown about the on-site well,
no one had the heart to tell Chapman that they had to cut his elevator out the budget.
Questions for the
Lassen County District Attorney:
1. Will Stacey Montgomery prosecute her husband for Perjury or will the State Attorney General have to do it?
2. Will Stacey Montgomery send a "Cease and Desist Notice" to force the Board of Supervisors to allow public comment on all Agenda items or will the Attorney General have to do it ?

"Stephen" Pezzullo owns 250 S. Pine Street, Susanville, Ca.
Pezzullo purchased this property in a bank foreclosure in 2011
As of March 21, 2016
Chris Montgomery (KSUE broadcaster & the DA's husband )submitted his Candidates papers, on March 11, 2016, to run for District 2 Supervisor
stating that 250 S. Pine was his legal address (under penalty of perjury)
Now, let's take a look at Pezzullo
Steve Pezzullo is a partner with Larry Smith and their HSP Resources (Hayes, Smith, Pezzullo)
Pezzullo failed to get the Amedee Airfield when Kan We Help filed papers that stopped the Board of Supervisors from including the Army's airfield in the thousands of contaminated Amedee parcels of public property the Supervisors gave Pezzullo and his partners for $25,000.
Pezzullo retaliated by filing a complaint against the Assessor for excluding the Army's Amedee Airfield, in Herlong, from his sale.
The Herlong sale was recorded
without including the Army's Airstrip.
The Fair Political Practice Commission fined Herlong's Supervisor Tom Hammond $2500 for a Conflict of Interest on the Herlong Sale
NEXT: Pezzullo then filed a complaint against
the Assessor for not living in Lassen
County when he ran for Assessor.
DA Montgomery attempted to prosecute the Assessor from Pezzullo's complaint. Fortunately, the DA's case fell apart in court when the case Montgomery filed was dismissed.
Then there are Pezzullo's thugs
How do "case titles" get reduced to initials?
The public could not do a "search" and find cases against Stephen Pezzullo or Larry Smith
This case originally had a case title of SP vs FD and Kan We Help asked the Court to correct the Case title. It was changed but they mis-spelled "Steven"

illegal new Chapman rule: Public needs a Sponsor to comment on Agenda
The Consent Calendar Rule Section 5 E has been in effect for decades allowing full and direct comments by the public.
On September 8, 2015, former District Attorney and now Lassen County Counsel Bob Burns pushed Supervisors to change the rule to violate the Brown Act. The advantage for the Supervisors was to put the majority of agenda items in the Consent Agenda to eliminate any public comments.
Kan We Help filed a Brown Act Complaint, against LMUD after suddenly all Agenda items had "INFORMATION ONLY" on Agenda items to eliminate any public comment.
LMUD General Manager Frank Cady boasted that District Attorney Bob Burns said it was legal.
Bob Burns demonstrates again and again that he is full of illiterate conceit
Supervisor Pyle was the Chairperson in 2015 and ignored the new illegal rule 8 times.
However, the old politician, Supervisor Chapman, knew the advantage of not letting the public *directly comment on the Consent Calendar Agenda and loaded the Consent Calendar with most of the Agenda.
*Jim Chapman's first Agenda, for 2016, after insisting he should be the Chairperson,
put 18 of the 25 Agenda items in the Consent Calendar.
Lassen County Board of Supervisors Meeting:
Raise your hand, get arrested
The Brown Act allows for the public to address "directly" all agenda items
NOT IN KING CHAPMAN'S COURT
Supervisor Chapman is now violating the law at every meeting.
kanwehelp.com Secretary Eileen Spencer raised her hand to comment on Supervisor Hemphill's " $700 donation" in Agenda Item B-4 (Unagendized Reports by Board Members). Chapman had talked over Hemphill during his Board Report. Supervisor Chapman looked down when Spencer's hand went up and Chapman attempted to go on to the next Agenda Item.
Supervisor Chapman did not ask for "Public Comment" on Agenda Item B-3
The old politician then threatened to arrest Spencer for "DISRUPTION"

LMUD VS HAYDEN HILL/KINROSS GOLD
In 2007, LMUD Director Fred Nagel, Accountant Bill Stewart and General Manager Frank Cady wrote a check for $65,000 for a worthless piece of land. Frank Cady and Fred Nagel did not inform the LMUD Board that the land needed $300,000 worth of mandatory restoration from the gold mining and that Surprise Valley Electric had no intention of bringing power back down to the gold mine.
LMUD Director Fred Nagel claimed that Frank Cady had no legal right to purchase this land even though the LMUD Board approved the purchase and Fred Nagel signed the check
Nagel 's remedy was to file a lawsuit on January 27, 2011, to void the purchase. After 5 years of shameful litigation and hundreds of thousands of dollars spent LMUD asks the Court to dismiss the lawsuit with prejudice. The Court vacated the April 11, 2016 trial and granted LMUD a "Motion to Dismiss".
NOW LMUD WANTS TO RAISE THE RATES (SERVICE CHARGE), ON MARCH 22,
TO WASTE MORE MONEY ON THE 230KV FOLLY THAT DOESN'T EXIST AND WILL NEVER EXIST.
LMUD has amassed millions for this fake project and now they want to raise more money that will sit in their bank accounts.

MOST PEOPLE FIND IT EASY TO BE HONEST, RICHARD EGAN FINDS HONESTY AN INCONVENIENCE
Lassen County CAo Richard Egan placed the majority of the Board of Supervisor's Agenda in the "Consent Calendar" (13 items). CAo Richard Egan has abused the "Consent Calendar" more than anyone else in the history of Lassen County government. He places Critical/Controversial issues in the Consent Calendar hoping no one will notice, including Supervisors. This Agenda category is voted on with one sweeping vote.
Agenda Item: G-8
TRANSFER OPERATIONAL CONTROL OF COUNTY OWNED PROPERTY
FUNDS WERE "NOT" AVAILABLE WITHIN THE SHERIFF'S DEPARTMENTS BUDGET
During the Budget process, Egan, Pyle and Chapman placed the $50,000 in PUBLIC WORKS Fund 588/Budget 943/Account 3002800 (paving).
CAO Egan and Supervisor Chapman were quick, to deny, that funds were being taken out of FUND 588 [PAVING], but Public Works Pete Heimbigner was quick to confirm the fact that the $50,000 is being taken out of "Paving" to pay back the USDA Grant.
The Sheriff's Department's budget is bare bones so $50,000 was placed in the the WESTWOOD PARKING LOT ACCOUNT, to pay back the USDA Grant, with the hopes that no one would notice
The Sheriff told Kan We Help that he has no idea how much money it will take to use and maintain the Westwood warehouse.
The Supervisors have a bigger problem:
Public Records indicate that the LCCDC never met to transfer ownership of this property
A similar stunt was performed when $142,000 was placed in the WESTWOOD LIBRARY FUND to replace the Library roof [ that was never done]. The Funds were used in Beiber

Lassen County District 1 Supervisor Bob Pyle told the group this is a "private property" issue not a community issue
PG &E owns the water rights to the Westwood Lake
Supervisor Pyle will not be running for re-election
Mountain Meadow/Walker Lake was drained, by PG&E on September 12, 2015 devastating the eco-system
...and Supervisor Pyle said it was a "private issue"
Friends of Mountain Meadows will be making a presentation at the March 8, 2016 Lassen County Board of Supervisors meeting. The next meeting of the group will be in Westwood on May 18, 2016.

Lassen-Modoc County Flood Control
and
Water Conservation District
Meeting
District elects new Chairperson from Modoc County
District 4-Modoc County Supervisor
Modoc County has three women on their Board and soon to be FOUR
Left to right: Vice-Chairperson (District 5) Geri Byrne, Chairperson (District 3) Kathie Rhoads, District 2 Supervisor Patricia Cullins
Approximately 30 attended the Flood District meeting at the Adin Community Hall, Modoc County
Lassen County Supervisors continue to abuse their positions on this Board
Lassen County CAO Richard Egan and County Counsel Bob Burns prepared the Agenda and Kan We Help documented the intentional Brown Act Violations (2013-2016)
Left: Lassen County CAo Richard Egan Right: Modoc County CAO Chester Robertson
INTENTIONAL BROWN ACT VIOLATIONS
Brown Act Section 54952.6
1. September 17, 2013Note: Rhetta Vander Ploeg was County Counsel
The Lassen County Supervisors held a Public Hearing without any Modoc County Supervisors. They voted to approve the 2013/2014 Flood Districts budget without a quorum. A quorum is six (6)
2. October 8, 2013Note: Rhetta Vander Ploeg was County Counsel
The Lassen County Supervisors failed to Notice a Public Hearing for the Flood District Budget and instead placed it on Department ReportsBrown Act Section 54954.6
3. July 15, 2014 Note: Bob Burns was County Counsel
The Lassen County Supervisors again hold a Public Hearing without any Modoc County Supervisors and approved the 2014/2015 Flood Districts budget. The budget was approved without a quorum
Lassen County Counsel Bob Burns advised the Flood District Board
to Break the law
FIRST:
Lassen County CAo Richard Egan & County Counsel Bob Burns prepared the February 23, 2016 Lassen-Modoc County Flood District Agenda, placed the required Legal Notice in the Lassen County Times but told the Modoc CAO Chester Robertson that he did not need to take out a Legal Notice in the Modoc County Record (A weekly publication that is circulated on Thursdays) Brown Act 54954.6.
THE BROWN ACT REQUIRES THAT MULTI-AGENCY PUBLIC ENTITIES MUST EACH POST LEGAL NOTICES FOR PUBLIC HEARINGS IN A NEWSPAPER OF GENERAL CIRCULATION WITHIN ITS JURISDICTION.
SECOND:
Lassen County Counsel attempted to run the meeting with numerous interruptions. Bob Burns told Chairperson Wills that he could "recess" the Lassen-Modoc County Flood Control Board and open the "Special Joint Meeting of the Lassen County and Modoc County Board of Supervisors" meeting scheduled for 2:00 PM
BIG PROBLEM, YOU CAN'T DO THAT
BUT THEY DID
The Agenda for the Flood District had been approved with no additions or deletions and there was nothing on this Agenda that would allow another meeting to take place during the Flood Districts meeting. The Flood District would have to adjourn and reconvene, but Burns new the restrictions on that route. He then suggested something that he knew to be "illegal".
BOB BURNS SHOULD BE WORKING ON HIS RESIGNATION LETTER?
Immediately after the Flood Districts "recess" Lassen County Supervisor Jim Chapman opened the "Special Joint Meeting".
While the Brown Act allows meetings/discussions between public agencies, it does not allow a public entity to take action/votes outside its jurisdiction. This meeting was held in Modoc County so the Lassen County Supervisors could only "discuss" issues during this "Special Joint Meeting". Brown Act Section 54954 (b)

SLEAZY IS, AS SLEAZY DOES
Lassen County Supervisors never intended to include the Modoc Supervisors ?
LASSEN COUNTY CAO RICHARD EGAN
PLANS TO HOLD YET ANOTHER
FLOOD CONTROL MEETING
WITHOUT THE
MODOC COUNTY SUPERVISORS
But where..... this meeting has been noticed for a Modoc County venue?
If the Modoc Supervisors cannot attend, the meeting must be cancelled
The Brown Act 54954 (b) 3 does not allow Lassen County to hold meetings outside their boundaries and take action (motion, resolution, ordinances, proposals). [No Modoc County Supervisor can attend or vote]
WILL EGAN CANCEL THE MEETING OR VIOLATE THE BROWN ACT AGAIN
MODOC COUNTY SUPERVISORS

Lassen County Supervisors
Properly Noticed the Flood District meeting
but
NOW cannot hold this meeting tomorrow, in Adin, which is in Modoc County
There is no quorum !
Lassen County, as an individual entity, cannot hold meetings & take action outside the boundaries of Lassen County, but Egan, Chapman and Burns know this ?

UNCERTAINTY LOOMS
OVER
LASSEN COUNTY'S RIVERSIDE PROPERTY
After six months of studying "space needs" and $37,335 later, the County is no closer to moving four County departments into the old BLM building at 2950 Riverside, Susanville.
The Supervisors told the public that this building could be purchased and remodeled for $1.7 million. However the County paid more than the property was worth [$1.3 million] and the improvements that need to be made have far exceeded the original estimates.
The County has $1.3 million left of the Certificate of Participation loan
MOST OF THE $1.3 MILLION WILL BE USED TO FIX THIS BUILDING........MAYBE ?
As we promised, Kan We Help is monitoring EVERY PENNY

Lassen County CAO attempts to increase a budget line item that didn't exist
Kan We Help is watching the 2015/2016 Budget very closely and told the Supervisors at the January 9, 2016 Board of Supervisors that Fund 100/Budget 0062/Account 3000131 did not exist
CAo Egan was quick to tell the Supervisors to ignore this comment because Fund 100/Budget 0062/Account 3000131 did exist.
WELL, IN FACT THIS LINE ITEM DID NOT EXIST
It is disturbing that the CAO can move money from one account to the other without the Supervisors ever knowing. As CAO he has the legal right to do this, but there are rules on "HOW" he does it and "WHERE" he does it.
The Westwood Library account is a good example. $142,000 was moved into this account and spent (over a number of years) to re-roof the small library in Westwood, but the Westwood Library has never been re-roofed.
This is a $7,000 job.
The Parks Budgets have been mis-used also.
Public Works Director Larry Millar has NO EXCUSES WHY THIS ROOF HAS NOT BEEN REPLACED.

Supervisors Pay Records Altered
Kan We Help has been requesting the Supervisors pay records for several years and we were disappointed that
"someone" made a decision to alter the payroll records.
This is the document Kan We Help received, on August 31, 2015 last year. The pay record shows that Supervisor Chapman received a base salary of
$40,534.83. This equates to 80 hours a pay period (26 pay periods in a calendar year)
Without any pay increases during the fiscal year 2014/2015 Supervisor Chapman's total "gross" pay was $40,534.83
The Ordinance that regulated the Supervisors pay during the 2014/2015 fiscal year stated the Supervisors pay was $35,485
There is no provision for any other pay, including longevity "pay" ( a bonus that is included in the Budget each year)
Kan We Help requested the Supervisors Pay Records after the Supervisors gave themselves a raise. The request was delayed until February 10, 2016.
and now we know why
They altered the "Amount", in the pay records,
to equal the
"legal Ordinance pay" of $35,585 for Albaugh and Hammond, but in Chapman and Pyle's case it still came out to $39,033.54.
BELOW:
The data has been removed from their pay history
Why?
Because they lied
to the public
about their pay
Supervisor Albaugh's calendar year pay is above Supervisor Chapman's

Did CAO Egan sleep through vote
Lassen County CAO Richard Egan
to award an engineering contract
for the courthouse modernization
Kan We Help asked for a copy of this $133,000 report that the Board approved on December 8, 2015
and Richard Egan claimed that it didn't exist
Richard Egan issued the RFP, for this contract, without going through the Lassen Board of Supervisors to be approved.
The secrecy was necessary because the Board never budgeted for Court renovations in the 2015/2016 Budget.
THIS WAS A CHAPMAN BACK DOOR DEAL ?
Chapman is obsessed about getting the new Board room while he is Chairperson
and has announced now that it would be done before he leaves office in January/2017
January 26, 2016
Lassen County Chamber of Commerce's
Dream for Susanville Ended
The Chamber of Commerce is a privately owned business that represents the philosophy of Republicans (not that this is a bad thing to represent a political party, but just a fact).
The Chamber often comes to the Board of Supervisors asking for money. Money for a fake Christmas tree for the town of Susanville. Most recently, the Supervisors gave this business $5,000 to enter a contest.
This contest ended and more than $50,000 was donated and spent for this contest.
What did the County get for $5,000 ?
NOTHING
The Lassen County Chamber of Commerce spent the $50,000 on CONCEPTS
MAYBE THE CHAMBER OF COMMERCE CAN SHARE
WHAT LASSEN COUNTY TAXPAYERS BOUGHT FOR THE
SUPERVISORS DONATION
Kan We Help called this a Ponzi Scheme from day one
January 20, 2016
LASSEN COUNTY SUPERVISORS
ALBAUGH, HAMMOND AND HEMPHILL
VOTED TO SPEND OVER $17,000
TO PLACE A STATE OF JEFFERSON CEREMONIAL VOTE
ON THE JUNE BALLOT
These three Supervisors, Albaugh, Hammond and Hemphill heard 42 minutes of reasons why any ballot measure from Lassen County would be just ceremonial.
YES OR NO, It will mean absolutely nothing.
California Counties are turning their backs on this Cult
and then there is Lassen County
looking like complete fools (Albaugh, Hammond & Hemphill)
The three, Albaugh, Hammond and Hemphill
voted for the "STATE OF IGNORANCE"
[seceding from the State of California is decided by the State Legislature]
No one from this 65 year old cult showed up but the Board of Supervisors heard that the State of Jefferson cult didn't need any support from Lassen County.
So why did these three, Albaugh, Hammond, Hemphill, discount the facts? Just Consider the history of these three Supervisors. What did Hammond get? Hammond is a Supervisor for Sale. Hemphill is just remarkably dumb. Albaugh, did this for Brian Dahle.
Brian Dahle has publicly stated that he wants to be the first Governor of the new State of Jefferson.

[Keeping all 58 Counties in tact]
Today theState of Jefferson Cult wants Lassen County Taxpayers to pay up to $17,000 to put their initiative on the Ballot
because they cannot get the signatures to do it on their own
Lassen County is a welfare county and depends on the 62% revenue from California to operate
THE STATE OF JEFFERSON CULT
OFFERS NOTHING
Plumas County Supervisors were smart and told them NO, on January 12, 2016

Modoc County Supervisors
Cancel yet another Flood District meeting date
made by
Lassen County CAO Richard Egan
Chapman jokes the meeting could take place in Modoc County's Alturas Court elevator

Watch and listen to Egan explain why the meeting was cancelled
Lassen County CAO Richard Egan continues to claim that a quorum for this ten member Board requires that all ten Supervisors must attend.
Egan also told the Lassen Supervisors that they can convene this Flood District meeting with five Lassen County Supervisors and one Modoc County Supervisor
THE REAL ISSUE: RANCHERS PYLE AND EGAN WANT CONTROL OVER THE GROUNDWATER

Three Supervisors from each County must attend to conduct business. In the past only Lassen County Supervisors have met and held meetings.
Lassen County Supervisors have held these meetings WITHOUT MODOC COUNTY and approved budgets and spent money ?
County Counsel placed a legal notice about a January 19, 2016 meeting in Adin without confirming that at least three Modoc Supervisors would attend.
Bob Burns comment: "There is a lot of fraud and abuse in Modoc County"
January 17, 2016
Lassen County Supervisors District 3
Taxpayers Deserve Representation
Newly elected (January/2015) District 3 Supervisor Jeff Hemphill does not give Board Reports when asked ( A report of what he has done to earn a paycheck). Hemphill just Passes.
He has had a month off and he reported NOTHING at the Board of Supervisors meeting on January 12, 2016 which is typical. Hemphill sits on this Board and waits for instructions from Pyle or Chapman. Chapman and Pyle control what Hemphill says and does.
Hemphill has had 12 months to DO SOMETHING, ANYTHING and all he has added to the meetings are crude offensive remarks about Supervisor Albaugh's private parts, his political opinions on who should be President....all of which have no place at a Board meeting.
Hemphill makes Motions for Pyle and Chapman and when asked what the Motion means, he looks like a deer in the headlights.
.....What motion, did I make a motion. Chapman, hand me that motion again. Hey, I need a little help here !
We will not say he is the dumbest and laziest Supervisor who ever sat on the Board.
NO, WE WILL NOT SAY THAT.
Watch:

Far left: Supervisor Hemphill, (red shirt) and (far right) Supervisor Pyle discussing the political rally they both attended
DID LASSEN COUNTY TAXPAYERS PAY FOR HEMPHILL & PYLE TO
ATTEND A TRUMP POLITICAL RALLY ON JANUARY 10, 2016 ?
DOES DISTRICT 3 DESERVE MORE THAN A TYPICAL ALFALFA MAFIA Good ole Boy to represent them...........?
January 15, 2016
2016 Will Not See A Change
In
Lassen County Corruption
You gotta watch the Lassen County Scoops"Changing of the Guards"
Immediately after taking his seat on the Board , District 5 Supervisor Tom Hammond voted to give 4,000 acres of public land to a friend where his Herlong businesses would benefit.
Tom Hammond then failed to disclose his business account with Lassen County and continues to receive thousands of dollars, from Lassen County, for his businesses in Herlong.
HAMMOND NEVER SAID A WORD UNTIL KWH DISCOVERED THIS
Crooked is as crooked does, Mr. Hammond
.....they own you......
IN LASSEN COUNTY THE CULTURE OF CORRUPTION
IS THE WAY OF LIFE.

Lassen County Supervisors
Will Have the $17,000
State of Jefferson issue on their
January 19, 2016 Agenda
State of Jefferson group has been picking the pockets of taxpayers all over California
and are being rejected.
Plumas County Supervisors rescinded their commitment to pay for this to be on their June Ballot
The SOJ Cult doesn't have any money or support
to put this on a ballot
January 12, 2016
Plumas County Board of Supervisors
Vote Unanimously
NOT TO PLACE THE
STATE OF JEFFERSON ISSUE
ON THEIR JUNE BALLOT
The "Keep it California" group has gained statewide support against this 65 year old group that has recently been resurrected
KEEP IT CALIFORNIA[Keeping all 58 Counties in tact]

Lassen County Supervisor Board
Will Elect A New Chairperson on January 12, 2016
Bob Pyle and Jim Chapman must step aside
and
Allow one of the remaining three Supervisors to take the Chair
Aaron Albaugh is the obvious choice
Supervisors Hammond, Hemphill and Albaugh should be appointed to all of the County Committees. Pyle and Chapman can stand aside and offer......whatever......
The question:
Will Pyle and Chapman's EGO'S let someone else learn the Board Chairman's job before they leave at the end of 2016.
