The LMUD Board was warned on February 4, 2005 not to include a "Public Employee Performance Evaluation" for Frank Cady in closed session. LMUD CLOSED SESSIONS
LMUD tells the public that they can go into closed session at any time.
The Brown Act states that they can only go into an "unagendized" closed session in "emergency" situations (work stoppage or natural disaster).
LMUD is trying very hard not to identify the subject matter of "closed sessions", in their agendas. The Brown Act requires public agencies to identify clearly to the public any closed session issues.
LMUD continues to abuse close sessions. No utility should have as many closed sessions on questionable legal actions. What are they really meeting on????????????

LMUD CONTINUES TO PLACE AGENDA ITEMS IN CLOSED SESSION THAT THEY ARE REQUIRED TO DISCUSS IN OPEN SESSION.
LMUD General Counsel found new way to spend more money now that Arrowrock is gone.
In closed session, at the May 6, 2004 LMUD meeting, Frank Cady asked the Board, after the motion had already been filed, to support the action he had taken concerning FERC ER04-688,690,693, (Pacific Gas and Electric Company's answer to the motion to Consolidate of the Transmission Agency of Northern California")
This is not a "closed session" agenda issue. The public had a right to full disclosure of this agenda item.
A Motion to Intervene was filed on April 21, 2004. Wallace Duncan and Lisa Gast, of the firm Duncan, Weinberg, Genzer & Pembroke, filed this Motion to Intervene on behalf of LMUD.
A full copy of this motion is available free from this website or from the FERC website.
This Motion to Intervene is an issue between PG&E and Western Area Power Association. LMUD buys a substantial amount of power from WAPA. This was an open session issue.
The LMUD minutes do not state the intent of this action, nor the benefit to the ratepayers.
PG&E's filing in Docket No. ER04-688-000 proposes to cancel PG&E's Rate Schedule FERC No. 35 simultaneously with the expiration of the "Contract with California companies for Extra High Voltage Transmission and Exchange Service among the Western Area Power Administration and PG&E, San Diego Gas & Electric Company"
PG&E is asking FERC to deny TANC's (Transmission Agency of Northern California) motion to consolidate the two dockets that will increase inefficiency.
LMUD ratepayers money was used and the ratepayers have a right to full disclosure. (What a concept)
All of the"big" power purchasers (400mw +) are involved
A 20mw power purchaser, LMUD, now wants to use ratepayer money to play with the BIG BOYS.

LMUD sent notices to the public that the April 1, 2004 meeting was to be held at 5:30 PM. The LMUD Agenda that was posted at the LMUD office at 2:30 PM on Thursday did not indicate that the meeting was cancelled. Bill Stewart said that he was going to be the only one at the meeting and he would announce that the meeting was cancelled because their was no business on the agenda...............
LMUD owes the public an apology for these shenanigans...... what poor management.
LMUD holds mandatory brown act seminar
This LMUD Board violates the Brown Act with every single meeting. Now they have to hold a Brown Act Seminar.
LMUD knows the Brown Act but refuses to comply with the law.
It's really simple:
Open all of the agenda items to the public for discussion
Stop threatening the public with arrest.
Start answering the publics questions.
LMUD announces at the March 29,2004 meeting that they will hold another meeting on April 1, 2004.
LMUD did not post the Agenda until Tuesday, 2004
LMUD could not have posted the April 1, 2004 agenda on 3/29/04. The LMUD Board didn't vote on whether this meeting was going to take place until 3/29/04. No 4/1/04 agenda was posted on 3/29/04.
KWH filed a Brown Act Violation on March 31, 2004. No proper notice was given by LMUD for their regular meeting.
KWH will see if these scoundrels bill the ratepayers for the April 1, 2004 meeting.

Brown Act 54953.5 (b) allows the public to file a Public Records Request, to view video tapes of public meetings. LMUD installed cameras in the LMUD Board room after February 18, 2003
KWH, under the Public Records Act, requested to view LMUD meeting tapes for 2003 September, November, and December.
"54953.5 (b) Any tape or film record of an open and public meeting made for whatever purpose by or at the direction of the local agency shall be subject to inspection pursuant to the California Public Records Act."

Langston throws KWH member out, during the five minutes allowed for public comment, because he didn't like what was being said.

LMUD: LANGSTONS MUNICIPAL UTILITY DISTRICT
Wayne Langston, the only Board member never to receive a single vote, stated at the beginning of the LMUD meeting (12/4/03) that he was tired of listening to the public criticize the LMUD Board and the management of LMUD and recommended that changes be made to the Public Comment portion of the meeting. The public now has five minutes to speak. Langston can reduce it to three minutes BUT HE STILL CAN NOT THROW PEOPLE OUT BECAUSE HE DOESN'T LIKE WHAT THEY SAID.
LANGSTON DOESN'T GET "BROWNIE" POINTS FOR INTELLIGENCE Wayne Langston violated the Brown Act by talking about an "unagendized" topic. Policies on Public Comment was not on the agenda. When Helene Williams, of Standish, told Langston that he had just violated the Brown Act, she was gaveled and told that this was the only warning she was going to get.
LANGSTON set the stage for the meeting. Wayne Langston waited until the public said something "HE" didn't like and threw the person out.
Wayne Langston plans to incite outrage from the public by thinking he has the right to discriminate what is said by the public.
The Brown Act allows the public to state their opinion. Public Officials have to listen, even if it is critical or insulting. Langston doesn't want to listen anymore to criticism so he throws the public out. Maybe the LMUD Board should start thinking about the overwhelming criticism and look at correcting their actions. NO,NO, NO.....that would be too easy, and moral, and ethical, and legal.
After the KWH member left the meeting, Langston never gaveled, reprimanded or threw out members of the public that continued to interrupt Langstons' illegal procedures. Langston targeted KWH.

FILED ON LAFCO
LAFCO agreed that after the Kenny/Cady issue that they would not pay John Kenny, LAFCO attorney, the $154.50 he charged the commission for his conversation with Frank Cady. Cady interfered with LAFCO business by hiring their attorney.
LAFCO also agreed that they would not authorize John Kenny's legal services contract until a determination could be made whether the Kenny/Cady issue was a direct conflict of interest.
LAFCO signed Kenny's contract on August 11, 2003, prior to their August meeting, prior to presenting it to the public.
Then the LAFCO Board presented this same legal services contract for approval at their September 15, 2003 regular meeting. This contract had been secretly signed prior to the vote to approve it.
The contract was never on a LAFCO agenda, prior to September 15, 2003.
The complaint asks that the cure be, to terminate Kenny's contract due to the fact that the Board secretly signed the contract.
This is the second action by John Kenny that is totally unethical. LAFCO needs to seek counsel that has a higher standard than Mr. Kenny has.

KWH sent the LMUD Board a copy of the District Attorneys letter that informs the LMUD Board that it must allow public comment during Board agenda item discussions.
Frank Cady advised them to just ignore the District Attorney.
