LMUD Directors fragile Ego's still run the utility district

The LMUD Directors signed an agreement with a Utah "political organization" that is not in the best interest of residents that receive power from the Lassen Municipal Utility District and raises issues that expose LMUD  to unnecessary risks.

Cady era Wayne Langston, Bill Stewart and Fred Nagel all supported the phony Idaho hydroelectric project and all of the phony NCPA projects. They approved money to be spent on these "Non-existent" projects and told the public lies and distortions to justify the expenditures.

UAMPS is not going to produce anything for LMUD residents.

Arrowrock produced nothing for LMUD residents.

NCPA phony projects produced nothing for LMUD residents.

 PSREC produced nothing for LMUD residents.

What these projects all have in common is the extensive travel to vacation/meetings  and  the only actual benefit was to UAMPS, BPBC (Arrowrock), NCPA (Resource 500, etc) and PSREC .   Every dollar given to these entities went down the toilet. LMUD residents received NOTHING but the bill $$$$$$$$$$$ .

NO bus stop for veterans

Dan Douglas, Lassen County Transportation Czar, decided that he would not create a bus stop at the new Veterans Medical building. This facility will open in April of 2010 and Mr. Douglas has refused to include this building in the Lassen Rural Bus route.

DAN DOUGLAS DISREGARDS PETITION TO PLACE COVERED KIOSK at Wal Mart location

Dan Douglas threw out a petition signed by 63 people to put a covered waiting area and lights at the new Wal-Mart bus stop. After the Wal-Mart remodel, Douglas refused to put the bus stop back at Wal-Mart and placed it on Riverside Drive. This location has no lighting, no seats and is exposed to the elements. Douglas has disregarded not only the decent needs of the veterans, elderly and disabled but every Lassen Rural Bus rider.

Lassen Rural Buses used to pick up and drop off passengers at Wal-Mart where there was a covered kiosk.  Dan Douglas moved  the bus stop to the street (Riverside Drive) (See second photo below)

A Public Records Request for the UAMPS project payments revealed that LMUD hides these payments as power purchases

As of today......LMUD continues to pay (On 10/1/09, Check #25191: $977.33. On 10/29/09, Check #25374: $1921.56) into this failed project.

This is exactly what LMUD did when Kan We Help exposed the phony NCPA projects. LMUD continued to pay NCPA thousands of dollars each month for absolutely nothing. These payments were made for "project costs" which did not exist.

UAMPS was repaid in June of 2009 and has yet to repay LMUD a dime. Why? 

LMUD continues to pay UAMPS $2,000-$3,000 a month.

But why is Ray Luhring and the LMUD ratepayers paying to wine and dine Rocky Deal OR George Sargent (10/9/09) or Bud Bowden (10/9/09) for that matter?   You won't see any of these expenses listed on his "EXPENSE REPORT". Luhring has a LMUD credit card which hides a lot of airfares, hotel and food bills for people other than LMUD employees.

Pezzullo gave LMUD a "Qualified" Audit in their 2003/2004 Audit. Steve Pezzullo exposed LMUD's accounting indiscretions and Frank didn't like it.

The Bloviating "CHAPMAN/bonham" Tag Team

Lassen County Supervisor Jim Chapman put Bonham on the Susanville City Council for a reason. Chapman and Bonham are both on the Local Area Formation Commission which basically controls the political influence of Lassen County. Between the three entities, Susanville City Council (Bonham), Lassen County Board of Supervisors (Chapman)and LAFCO (Chapman/Bonham), they believe that they can control the policies in Lassen County.

Recently, Supervisor Chapman and Mayor Bonham both tag teamed LMUD's boundary issue at the LAFCO meeting. LMUD attempted to include other Lassen County "private" utility companies within their influence in order to continue to include them in their elections. LAFCO Alternate Jim Chapman argued that the voters determined the original LMUD boundaries therefore they should stay the same. While KWH argued that the LMUD "boundaries" can only be the area that LMUD has influence over (residents that live within LMUD's service area), Chapman knew that "his" statement was not true.

The Board of Supervisors determined LMUD's original boundaries not the voters . Why did Chapman lie?

Now, Chapman and Bonham are working together to slide the sale of this "NEWLY CREATED" GOLF COURSE PARCEL through LAFCO, LASSEN COUNTY BOARD OF SUPERVISORS AND FINALLY THE SUSANVILLE CITY COUNCIL. While there is a definite connection between Bonham and Cady, no connection has ever been made between Chapman and Cady until now.

WHY?  The City of Susanville allowed a private citizen to use public land as collateral for a $1.4 million private loan

When the electric rates are going down all over the country, LMUD management buys new trucks, redefines management positions in order to raise management salaries, CONTINUES to spend thousands and thousands of dollars on expensive "vacation meetings" for NON-PROJECTS and refuses to reduce LMUD rates.

It's just too easy to fall into the corruption at LMUD when there is no oversight by the public. .......or will the oversight come in the 2010 LMUD election.

The Lassen Municipal Utility District could never bring in an "outsider" as their General Counsel. As long as this Board continues it's sleazy practices they will need someone like Cady. Frank Cady's close friends, Langston and Nagel, will continue the "back room" deals for phony projects.

Judge Ridgely Lazard kept LMUD Board out of Jail

on "Arrowrock"  issue

In December 2002, Kan We Help filed a Writ of Mandate for  a copy of LMUD's "Arrowrock Feasibility Study" that was jointly funded by the Boise Project Board of Controls and LMUD. This study was completed and released in October of 2001 and the 193 page  "amended study" was completed and released in September 2005.

These two studies were always available.  LMUD could have released the study, but they would have been caught in HUGE LIES AND MIS-USE OF PUBLIC FUNDS.   You can read them here. Click on "links", Arrowrock RFP 

Judge Lazard refused to look at the completed 2001 Arrowrock Feasibility Study, in court,  and ruled that this was a frivolous request by KWH and fined KWH $70,000. Unheard of in the history of California.

Hundreds of thousands of dollars was spent on this very "secret" project. LMUD attorneys, Cady and Jones were paid thousands of dollars to "lie" about Arrowrock. The LMUD Board members, Mario Gianotti, Wayne Langston, Darrell Wood, Templeton and  Parker.....all should have been indicted.

What is really sad....why didn't they just tell the truth?

ENFORCEMENT OF JUDGMENT AGAINST KAN WE HELP

Frank Cady filed the first Abstract Judgment against a KWH member (Case 36791) under the wrong name and then claimed that a Title Company did not catch his mistake.

Judge Bradbury, on June 4, 2009, throws out the incorrect Abstract Judgment Cady filed in an attempt to cover up this act of incompetency. Judge Bradbury cooperated when LMUD needed this mistake to go away.

Then Judge Bradbury interfered, in case (42831),  to make it appear as though LMUD lost the lawsuit that was filed by David Jenne/Cal Sierra Title against LMUD. Judge Darlington was the judge-of-record in this case, not Bradbury.

LMUD, with the help of Judge Bradbury extorted $7500 from David Jenne via Cal Sierra Title, in Susanville.

Judge Stephen Bradbury was a partner in "BKC"   , a company disguised as a real estate company. His partners, U.S. Magistrate Craig Kellison, and Susanville attorney Frank Cady helped local citizens find BIG BUYERS for their property.

The "partnership" owned 60 S. Lassen. It appears that Judge Bradbury fronted the purchase money for this property and maintained an interest until January 31, 2006.

Frank Cady wanted to become the LMUD General Manager but had huge conflict of interest issues.

• Judge Bradbury still had an interest in 60 S. Lassen

• U.S. Magistrate Craig Kellison still had an interest in 60 S. Lassen

• Cady had registered with the State of California as a "Partnership" with Jaimee Richey/Jones in January 2005.

• Cady had to appear to divest himself from his law partner, Jaimee Richey/Jones so he could be hired by  LMUD

Let the games begin

1. Frank Cady made it appear that he divested himself from his law partner by selling his interest in 60 S. Lassen

2. U.S. Magistrate Kellison, five days later records the sale of his interest in 60 S. Lassen, to Frank Cady.

OWNERS OF 60 S. Lassen:  Bradbury, Cady and Richey/Jones

Judge Bradbury, Judge Kellison and Frank Cady waited six months to get Judge Bradbury out of the deal.

JUDGE STEPHEN BRADBURY GIVES MORE FAVORS.........

  A few months after Judge Bradbury "signed" ($$$$$$$) off on the 60 S. Lassen property,  he placed LMUD's attorney, Jaimee Richey/ Jones, on the Grand Jury and then on September 29, 2006 Lassen Municipal Utility District filed a "Levy" and "Forced Sale" against 1285 Orlo Street in Susanville in order to collect the judgment against a KWH member. This is the only action LMUD took to collect this Judgment.

Judge Darlington was the JUDGE OF RECORD on this case. NO SUBSTITUTION, NO RECUSAL WAS EVER MADE

A lawsuit was filed [ Jenne v LMUD, 42831] to stop LMUD from selling this property

KEEP IN MIND, JUDGE DARLINGTON ISSUED THE ORDER ON MARCH 10, 2009 STATING THAT THE LMUD JUDGMENT WOULD BE RESOLVED BY THE JURY IN CASE 42544.  

JUDGE DARLINGTON WAS THE JUDGE OF RECORD IN THE JENNE V LMUD CASE.

JUDGE BRADBURY JUMPS IN AND SIGNS THIS "ENTRY OF JUDGMENT" IN THE JENNE V LMUD CASE

On June 4, 2009, Judge Bradbury signs this Deceptive order which makes it appear that the Plaintiff won, but in fact the Plaintiff, David Jenne paid LMUD $7500 to settle the KWH  judgment.

THE  BAILED OUT BANKS CONTINUE TO ABUSE CONSUMERS

$23.7 BILLION DOLLAR late charge, overdraft POLICIES

1. Immediately after the bank bailout, the banks sent letters to their consumers announcing rate increases. Some rates reached 37.9%.

2.These same bailed out banks are charging anywhere from $35-$39 for late fees and overdraft charges. This is a $23.7 billion dollar policy.

3. Consumers are reporting that banks are holding customers deposits and credit card payments until after the due dates in order to charge late fees and overdraft charges.

4. Consumers are being charged interest on these late fees and overdraft charges. $4.3 Billion dollar policy

5. Banks are charging $5.00 to $15.00 for payments by phone or internet payments.

1. Call your Senator or Congressman and report abuses. Congress is working on legislation to stop these abuses. They need to hear from you.  Congress is working on a bill to prevent abuses by credit card companies but it doesn't go far enough.

California Municipal Utilities, EBMUD, SMUD and LMUD, boundaries will be determined by the 2010 census

The 2010 Census will ask what utility district you are "serviced" by and the Municipal Utility Districts political boundaries will be  determined by the results. These results will be submitted to the Registrar of Voters in each of the three MUD's. This effects elections in the three districts. 

"Private" utility customers will no longer be able to vote on the municipal utility district elections or sit on their boards.

LMUD recently attempted a last ditch effort, at LAFCO, to include the "private" utility companies in their "sphere of influence".

In 2005, Kan We Help filed a complaint with Lassen Municipal Utility District and the District Attorney when LMUD hired their attorney, Frank Cady, to be their next General Manager.   Both KWH  complaints were ignored.

Cady's law firm, which included his law partner Richey/Jones, had a contract with Lassen Municipal Utility District.  

To give the appearance that Kellison & Cady (not Bradbury) was selling this property they did the following:

First Frank Cady sold his interest to Jaimee Richey/Jones on 6/30/05

then

Craig Kellison sold his interest to Frank Cady on 7/5/05

Now legally, on 7/5/05......Stephen Bradbury, Frank Cady and Jaimee Richey/Jones owned 60 S. Lassen Street

Now, you are probably wondering what happened to Judge Bradbury.

But, on January 31, 2006 (six months later) Judge Bradbury was paid-off by Craig Kellison and Frank Cady, allegedly for his interest in 60 S. Lassen Street.

County Supervisor Jim Chapman Deliberately Misleads LAFCO

Why?

LAFCO Commissioner: L to R, Alerternate Jim Chapman, Mr. Keefer, Mr. Eid, Mr. Bonham, Mr. Franco

County Supervisor Chapman took advantage of the LAFCO commissioners lack of knowledge of the LMUD formation process. Clearly, Keefer, Franco and Eid had no idea about LMUD boundaries or the formation of LMUD.

Chapman continued to tell the other Commissioners that voters "VOTED ON THE LMUD BOUNDARIES".  This was simply a lie and Chapman knew it was a lie. The other members of LAFCO depended on this statement as being true.

Chapman claimed he was part of the formation committee to create LMUD. If that was the case then he knows that the Board of Supervisors created the boundaries and that voters NEVER voted on the LMUD boundaries.

The Board of Supervisors are charged with, under the Municipal Utility Act (which governs LMUD),

First,  to pass a Resolution to move forward with the formation of the LMUD district (which they did not comply with),

Second to create LMUD's ward boundaries,

Third, to send the voters a notice of the proposed utility district which includes a description of the boundaries they created,

Fourth,  to call for an election by the voters to have/or not have the LMUD district,

Fifth,  to call for an election of ward directors if the vote is in the affirmative to create LMUD.

NOTE: It is unfortunate that the Commissioners have so little knowledge of the Local Formation Agency commission. What is even worse, the current commissioners have no interest in educating themselves. It is a board of political opportunity and appears to be beholding to a small group of self-serving local entities. It certainly does not appear to serve the publics interest.

NOTE: In 2003, LMUD's attorney (Frank Cady) paid LAFCO's attorney (John Kenny), to take the LMUD boundary issue off the LAFCO agenda.

LAFCO REMOVES SURPRISE VALLEY ELECTRIC, PSREC AND PGE FROM LMUD'S BOUNDARY MAP

County Supervisor Jim Chapman sat in on the LAFCO Board meeting today, due to the absence of Jack Hanson.

Chapman stated, incorrectly, that the LMUD boundaries where voted on by the PUBLIC and therefore should remain until voted on again

The formation process is defined in the Public Utilities Code

CPUC, Division 6, Section 11642: Before calling the election the board of supervisors shall divide the proposed district into five wards, the boundaries of which shall be drawn that each shall contain approximately an equal number of voters, as nearly as may be. The public agencies and any other territory included in the proposed district may be divided for the purpose of establishing ward boundaries.

The Board of Supervisors were required, by Resolution, to create LMUD's boundaries (Section 11643.1)

LAFCO "Motivated" to Change LMUD Ward Boundary's

On September 14, at 3:00 PM (707 Nevada, Susanville) Lassen Municipal Utility District will ask LAFCO to change their boundary map to include all other electric companies in Lassen County

LMUD ASKS LAFCO  TO CHANGE ITS SERVICE AREA ON SEPTEMBER 14, 2009

If approved as written, LAFCO,  will allow PGE, Surprise Valley Electric and PSREC registered voters to vote in LMUD elections and run for the LMUD Board.

LMUD's current map intentionally does not define the PSREC territory so Fred Nagel can remain on the LMUD Board. The Resolutions before LAFCO on September 14, 2009 will make Nagel a "legal" LMUD board member.

The downside is that this action will also allow PGE, Surprise Valley Electric and PSREC registered voters to control LMUD rates, policies and procedures if they sit on the LMUD Board. LMUD's elections are "at large".  Which means that  all four electric companies registered voters will receive LMUD ballots.

Two Susanville City Council members (Franco & Bonham) and two Lassen County Supervisors (Hanson & Keefer) will decide to allow LMUD to violate other electric districts boundaries

Supervisor Jim Chapman and Kurt Bonham, in tandem, told the LAFCO members, at the August 10, 2009 meeting, that the LMUD boundary issue is a political issue. Chapman and Bonham said "Let the voters decide". DECIDE WHAT GENTLEMEN? This will be decided by the LAFCO Board

If this map is approved, the Lassen County Election Officer must accept candidates [for future LMUD elections] from voters that are registered and reside within PGE, Surprise Valley Electric and PSREC boundaries. PSREC voters are presently allowed to run for LMUD Board positions because of the LMUD map (Langston & Nagel)

Supervisor Chapman stated that PSREC voters were only 600 voters and it was insignificant to LMUD elections. Chapman presented the "Simpson" map that was submitted prior to LMUD becoming a Special District which included the PSREC service territory.  This map was never used for the formation.

LAFCO  CONCLUDES THAT PSREC "TOUCHES" LMUD BOUNDARIES THEREFORE PSREC IS "WITHIN" LMUD BOUNDARIES.

Bill Stewart has been trained by the previous LMUD General Manager to post Board expenses where they cannot be easily found by the general public.

Stewart posts conference fees in "Maintenance & Operations"?  Stewart went on this Utah trip in June. No registration was paid for him to attend, so WHY WAS HE THERE? ........VACATION MEETING PERHAPS.

First, if the public wanted a copy of any Board members expenses they would expect to see "all" expenses listed on their "EXPENSE REPORTS". A Board Member could easily list all of their expenses and note that they were paid for by LMUD or the General Manager could "fill in the expenses" prepaid by LMUD prior to signing the report.  

But, then the public would know that a $550 trip was actually a $1600 trip

Second, if the public was privy to the LMUD accounting codes they could ask for copies of Board Expenses and assume that all Board expenses would be posted there.  NOT TRUE.

The public has a right to full disclosure.

 Frank Cady used to hide the extravagant expenses all over the map, so any reasonable person could not possibly track the exact costs of the vacation meetings with NCPA and the other 17 country club energy companies that LMUD belonged to.

Lassen Municipal Utility District finds itself "advertising" for a different attorney and issues a RFP.

Frank Cady and his father were the original attorneys representing LMUD when it was organized in 1989 and were paid $1,000 a month. Craig Kellison and Frank Cady continued to represent LMUD for $1,000 a month until Cady got greedy and Kellison left the law firm.

In July of 2005, the LMUD Board recklessly  hired Frank Cady as their General Manager and hired Cady's law partner, Jaimee Jones, as their attorney (LMUD's more than Bogus RFP that was issued never intended to attract any candidates. Cady had already convinced the Board to hire his law partner). Two and a half years later, both attorneys were fired.

Frank Cady was fired on January 4, 2008 .

The court ruled that Frank Cady's "behavior was so outside the bounds of civilized behavior as to be outrageous"   What the court did not note was the outrageous behavior of the LMUD Board that allowed and even encouraged Frank Cady's perverted behavior.

LMUD Board members Nancy Cardenas, George Sargent and Darrell Woods had the decency to RESIGN. Langston and Nagel, friends of Frank Cady, should have resigned but did not. This Board was so corrupt as to boggle the mind.

Where is this Board going to find an attorney that will allow Brown Act Violations, Abuse and Mis-use of Public Funds, Hidden Expenses and General Dis-honesty? Time will answer that question.

Lassen Animal Rescue places condemned dog

Rhett and his sister Shyla were rescued from the Lassen County Animal Control the day before they were to be euthanized. Rhett and his sister Shyla were declared feral (wild) dogs because they had never had any human contact. LCAC confiscated two litters of dogs that had been abandoned on a local ranch. Lassen Animal Rescue volunteers worked with both dogs and placed them with extraordinary families.

Rhett is now with a loving 4-H family and loves pigs.

Judge Bradbury, not known for his love of "dogs", threw out not only the State requirement and definition on "vicious dogs"  but County and City animal codes as well and ordered, at the request of the City Attorney, two dogs killed. There was no clear evidence that this was an "unprovoked" incident. It simply didn't matter to Judge Bradbury or Susanville City Attorney.

Because it could not be determined "who" did the bite, the two "unaltered" dogs were impounded at the County pound and placed in the same kennel. The female became pregnant (duh) and has given birth to seven puppies at the County Pound. The mother of these puppies was ordered killed. Animal Control Officer Judy Walesch stated that the puppies will not be put up for adoption because the mother has been determined to be "VICIOUS".  The Susanville City Attorney did not inform Judge Bradbury that there were puppies involved?????
 

The City of Susanville no longer has an Animal Control person. Susanville Police are now responding to all animal issues within the City limits.

The Susanville City Attorney has now set a precedent for "one bite" incidents.

If your dog bites someone within the Susanville City limits, IT WILL BE ORDERED KILLED. IT WILL NOT MATTER IF IT WAS PROVOKED OR UNPROVOKED.

Wood and Sargent had the decency to resign). They supported keeping Cady , they supported all of the phony energy projects, supported hiding Board expenses in Frank Cady's Expense Reports, the PCB contamination cover-up, and the Beterbide land scam.

The Lassen County Superior Court and the Third District Court of Appeals identified and determined that Frank Cady and Jaimee Richey/Jones overbilled the Lassen  Municipal Utility District thousands of dollars for the KWH v LMUD lawsuit. This doesn't even scratch the surface in the ten years of Cady's "obscene" legal invoices.

Wouldn't it be nice if the Lassen County District Attorney wasn't joined at the hip with the Nagels and Cady's?

LMUD General Counsel Position Misused for Years

It appears that the LMUD Board has rid themselves of the wasteful expense of abusive legal services by firing Frank Cady and Jaimee Jones of "Cady, Pardee & Jones".

Jaimee Jone's 1099 shows that LMUD paid her $52,372.67 for six months work in 2005. Jones was given the position after her law partner Frank Cady was hired as LMUD's General Manager in July of 2005. This amount does not reflect the amount paid to her for the entire year. Jones was also given full benefits equivalent to $40,000 a year.

This small utility has been mismanaged since its inception in 1989. Cady has been around since the inception. Now that the largest cancers have now been removed, LMUD has an opportunity to operate in the best interest of the ratepayers......can it be done......will this done......we'll see............

The public has displayed outrage of Frank Cady's abuses for years and the LMUD Boards did nothing but reward Cady. These were elected officials.....Cady was always just an employee.    Cady was allowed to bill $300,000 a year for legal charges that were more than highly suspect.

Cady and the LMUD Board's have supported phony energy projects for years that provided obscenely expensive "vacation" business meetings. While Cady was LMUD's General Manager, he spent thousands of dollars to send the LMUD Board and LMUD management staff to Invenergy's office. PUBLIC BEWARE: LMUD has no contract with Invenergy.....just continuing bogus promises.

LMUD Directors Mario "Buzz" Gianotti, Richard Parker, Louie Templeton and Darrell Wood were thrown out of office for their role in the abusive spending and mismanagement of this small public utility. Their attorney, Frank Cady, could not protect them from the public's disgust.

Nancy Cardenas, George Sargent, Al Vasquez and Darrell Wood replaced four recalled LMUD Directors. Al Vasquez was replaced by Fred Nagel when Vasquez started questioning the Board's direction.

Cardenas, Sargent and Wood later resigned, in 2007,  when it appeared Frank Cady was out of control and they did not have the courage OR inclination to correct his behavior.

The LMUD Board allowed Cady to run the Susanville Golf Course while he was LMUD's fulltime General Manager. The LMUD Board, Nancy Cardenas, George Sargent, Darrell Wood (all resigned), Fred Nagel and  Nagel's son-in-law Wayne Langston let Frank Cady and Jaimee Jones abuse their positions for years. These five allowed Cady and Jones to bill over $300,000 a year in contrived legal issues. Kan We Help complaints fell on DEAF EARS.

Visiting Judge to determine KWH's ability to pay $50,000 fee award on Public Records lawsuit

LMUD's fired attorney, Jaimee Richey/Jones, not LMUD's new interim attorney Mr. Gartner, appeared in court on February 9, 2009, to ask Judge Darlington to take KWH members homes, cars and income. She wants non- KWH members spouses and children's income also.

NOTE:  Cady and Jones refused to release the Arrowrock documents and their invoices for Arrowrock work. Kan We Help lost the Public Records lawsuit to obtain these public documents. Kan We Help obtained enough documents from federal agencies to suspect wrong doing by LMUD and their law firm prior to filing the lawsuit. Frank Cady fought KWH's action to keep from going to jail... to keep Langston, Parker, Templeton, Woods out of jail also. It worked.

A New Era at LMUD.......hopefully

It took the LMUD employees and fed up ratepayers to usher in a new era at this public utility.

  KWH  (a local watchdog group) dared to file a Writ of Mandate to obtain public documents, in 2002, to expose the corruption at this small utility.

The ratepayers dared to recall the LMUD Board.

The employees dared to demand that Frank Cady be fired.

In 2002, LMUD would not disclose what they were paying the Board members and what they were spending on the phony Arrowrock hydro project.

KWH did an unprecedented act...they challenged Frank Cady. 

To request public documents from LMUD then... you would be met with insults and threats by Frank Cady and you would not have a remote chance of obtaining ANY PUBLIC DOCUMENTS FROM LMUD. Frank made sure of that. 

KWH has dozens of insulting and threatening letters from Frank Cady. When KWH persisted, the documents received were redacted so heavily that they were unrecognizable.

Other than employee records, there isn't too much at LMUD that is not disclosable, but the newly replaced LMUD Board members were told by Frank Cady that the public does not have a right to know how much they are spending and what they are spending the public money on. Board expenses were being hidden in their attorney's invoices.

KWH requested records of the Board Salaries. These salaries are fixed at a maximum of $600 a month (by law). LMUD's attorneys, Frank Cady & Jaimee Richey/Jones refused to disclose these documents.

KWH requested a copy of the Arrowrock Feasibility Study. The ratepayers were told that they paid for this study ($150,000). Frank Cady went into court and lied. He told the court that this was never finished, it was only a "DRAFT" Cady claimed and it didn't belong to LMUD. Yet, this FINISHED study was used in a RFP for the Arrowrock Hydro Project in March of 2002, prior to the KWH filing the Public Records lawsuit in December of 2002.

 JUDGE RIDGELY LAZARD "REFUSED TO LOOK AT THE STUDY" IN ORDER TO DETERMINE IF IT WAS A "DRAFT"

LMUD, according to FERC documents, was involved with the Arrowrock project from December 2000 to December 2001. Due to lack of feasibility, the project did not move forward and the FERC license was terminated by the Federal Energy Regulatory Commission.

KWH requested copies of Frank Cady's and Jaimee Richey/Jones legal invoices for their Arrowrock work. Frank Cady admits to working on and being paid for  Arrowrock but tells the court that he did not itemize the work.  Cady claimed that, for the period that KWH was requesting, these invoices suddenly did not identify Arrowrock work.

 JUDGE RIDGELY LAZARD "REFUSED TO LOOK AT CADY'S INVOICES" IN ORDER TO DETERMINE IF THERE WERE ARROWROCK ENTRIES.

Judge Ridgely Lazard (this judge lost his seat on the bench at the next election) ruled that this Writ of Mandate was "frivolous".

FRIVOLOUS (?)..... IT WAS NOT

KWH members spent thousands and thousands of dollars to obtain public documents that should have been released  in ten days...the time allowed by law !!!!!

But, the Arrowrock documents

would have put

Cady & Jones in jail for fraud

Judge Lizard (a very close friend of Cady) ruled that KWH must pay $74,000 in legal fees. This decision was meant to leave a "chilling effect" on anyone else that would dare to question Frank Cady.

This amount was based on Frank Cady and Jaimee Richey/Jones "Exhibit A" that they submitted to Lazard. This "doctored document" was supposed to represent what the two attorneys charged LMUD to handle the Public Records lawsuit.

Also, it was revealed that Cady and Richey/Jones overcharged LMUD for this work. A one page document..$800. They charged LMUD for meetings that did not occur, preparation for subpoenas and lawsuits never used, 80 hours for preparing a 3 page document that was never used....gross overcharging.

KWH submitted to the court that this "Exhibit A" had been grossly and fraudulently inflated. Fortunately KWH had the Cady invoices to compare to "Exhibit A". Judge Lazard agreed and reduced it by $24,000. Cady and Richey/Jones had included fictitious charges.

KWH appealed Lazard's decision in the Third District Court of Appeals. The Appellate court upheld Lazard's ruling but questioned again more of Cady's alleged legal costs.

 KWH feels that the Appellate court appreciated, as did Lazard, that to overturn the lower courts decision would then expose Cady, Richey/Jones and the LMUD Board to fraud.

Lassen County visiting Judge  to determine if KWH must pay the $50,000

KWH and Jaimee Richey/Jones (Jaimee Jones was recently fired by LMUD on 1/27/09) appeared in court on

 2/9/09 to determine KWH's ability to pay $50,000 in legal fees awarded to LMUD from the Public Records lawsuit KWH filed in 2002 to obtain LMUD's Arrowrock documents.

 Jones admitted, to the court, that many mistakes were made on "Exhibit A" (legal costs).

KWH submitted evidence to the court that LMUD had been consistently "overcharged" by Jones and Cady over a period of seven years. (Please do not ask KWH why the LMUD board has tolerated this excessive billing........this is a question for the LMUD Board)

The Third Appellate Court remanded this case back to Lassen County to determine the "ability to pay".

Jaimee Richey/Jones has been ordered, by the current LMUD board (The two remaining LMUD Directors, Langston and Nagel, supported their close friend, Frank Cady from 2000-2007),  to go after pensions, savings, homes, vehicles, personal property and anything of value to repay the ($)$50,000(?) so as to deter the public from ever invading their "private" company again.

There was no order for Jaimee Richey/Jones or Frank Cady to "repay" the seven years of inflated, grossly excessive and fraudulent legal invoices charged to LMUD

......that was the Bad News. the good news is:

Judge Lazard was not re-elected

Frank Cady was fired

Jaimee Jones was fired

the phony Arrowrock Hydro project was terminated

More corrupt LMUD members are gone

LMUD's Public Records Policy Needs to Change and comply with the law

1. The present policy of Lassen  Municipal Utility District's is to demand that the person requesting public documents must use LMUD's  PRA form. The Third District Court of Appeals deemed this policy not in compliance with the Public Records Act. The Court stated that the Public Records Act requests can be in written form or by an oral request. LMUD attorney's have been allowed to delay and refuse requests because the Requester has not used one of LMUD's forms. LMUD's PRA form cannot be "mandatory".

2. Next, the requests for public document are given to their attorney to process. This is a very expensive and unnecessary step Cady installed as a "selfserving" policy. This policy increased his legal fees. The flaw in this policy was also ABUSE.  The LMUD General Manager makes the copies but never knows what documents are eventually sent out or what has been redacted.

Example: Les Leiber was appointed interim General Manager when LMUD's 5th General Manager (in a two year period)  Evelene Twitchell "suddenly" left. KWH had attempted to get confirmation of the LMUD Board's payments many different ways. KWH was attempting to confirm that the LMUD Board was not being "overpaid". All requests were initially denied.

In a final attempt to obtain this "disclosable" record, KWH requested copies of the General Ledger account for Board salaries. Leiber complied and made copies of a spread sheet that he claimed had each of the Board members gross salaries on it.  This was clearly in compliance with KWH's request for these documents. However, these spreadsheets were ultimately released by Frank Cady to KWH without the "amounts".  The court relied heavily on Les Leiber's declaration that he indeed gave these documents to Frank Cady with the Board salaries.  What Les Leiber did not know was that Cady did not send those documents.

KWH then included this issue of non-compliance, in their Writ of Mandate filed in December 2002. What was amazing was that when the Writ was heard in Court, Frank Cady lied to the court and produced the spreadsheets with the board salaries clearly included and noted the stamped document numbers at the bottom. The only problem, LMUD was not stamping documents then. Cady was caught in an outright lie and Judge Lazard just ....overlooked Cady's lie.

3.The General Manager should be able to manage the PRA requests. If a questionable request is received then ask for legal advice. There isn't very much that is not disclosable at this public utility and the exceptions should be very easily identified by LMUD's General Manager.

In 2006, Jaimee Richey, Fred Nagel and Frank Cady negotiated to buy property for LMUD from their friend Jack Beterbide that coincidentally Beterbide didn't even own the property AND VIOLATED THE BROWN ACT to boot.

In March of 2006, Kan We Help filed a Brown Act complaint with Robert Burns, which was ignored. Now we know why.
