[Bieber Park, Brian Dahle's District, gets $250,000]
In 2010, Supervisor Keefer wanted to build a new community Park in Johnstonville. The County had access to Prop 40 funds (2002, California Clean Water, Clean Air, Safe Neighborhood Parks and Coastal Protection Act).and Supervisor Keefer wanted to use these funds for a community park in his District.
The County land in Johnstonville soon proved to be unsuitable due to drainage issues. Caltrans yard across the road drained into the proposed park land. Caltrans was asked to mitigate this and agreed to grade their land so the water would be re-directed.
According to public records, the County budgeted $25,000 for the Park in 2010 but never spent anything. The Park was then re-located to Janesville and has now been re-named after Supervisor Keefer who lost his bid for re-election to Larry Wosick (a one term Supervisor)

Brian Dahle was Supervisor of District 4 in 2010. $250,000 was placed in the 2010/2011 Budget for his Bieber Park.

The Lassen County Court House was registered with the National Register of Historic Places on January 23, 1998 as the "Courthouse Square"
According to public records, Lassen County has pulled many permits, since 2012, to remodel this Court House after the new $38 million dollar Hall of Justice was built on Riverside Drive. This building falls under the Americans with Disabilities Act (ADA).
NOTE: Lionakis was the Architect that designed the new Hall of Justice. Lassen County Supervisors just signed a $133,000 contract with Lionakis to study the old Court.
Many space needs studies have been done and the County is well aware of each and every inch of this building. The $133,000 is a gross waste of tax payers money

GONE IS THE STUPID 25% OF A SUPERIOR COURT JUDGES SALARY
WHAT was added IS THE SECRET BONUS PAY
The Longevity pay: this is a 15 year bonus salary program for Supervisors.
After 7 years of service the Supervisors get a 2 1/2% bonus. But they are given 5 years seniority automatically the day they are elected so after two years they are quietly given this 2 1/2 % bonus pay. A Supervisor gets another 2 1/2% raise if they are re-elected. After ten years in office (2 1/2 terms) they get an automatic 7% bonus pay.
Kan We Help has objected, for many years, to this secret Bonus because it exceeds the Statutory Pay limit
This "longevity pay" was excluded in the 2013 Salary increase
All salary/pay is regulated through this Ordinance and there is no mention of an additional "longevity pay" and yet all Supervisors received this pay.
Benefits are defined here as health benefits, life insurance, retirement benefits but does not include any "salary/pay" increases.

space needs for the old Court House
{Past studies have been expensive and never used. This will be no different}
They approved the unbudgeted $133,000 contract for the Old Courthouse without considering the fact that they have no idea what it will cost to fix the Riverside building and move four Departments.
CAO Egan was asked several times how much it will cost and he went from "I don't know to "maybe $200,000 or $300,000.
The public was told $600,000 and that was before they found out all of the repairs that will be needed before anyone moves in.

Board of Supervisors Board room
On January 21, 2013 Supervisor Chapman led a tour of the old Court Annex space in the basement of the County Administration Building on Roop Street
Without any authority, Chapman instructed NST to proceed with plans to
remodel this Courtroom into a Board Room
Jeff Morish, from NST, told the Board on February 11, 2013, a Master Plan should be done first. Chapman really showed no interest in doing this the right way. Chapman wants a new Big Board Room with all of the bells and whistles.
On April 23, 2013 Board of Supervisors meeting, Supervisor Chapman pushed to approve a contract with NST to "study" the use of the Court Annex for space and design. Soopervisor Chapman pushed to get his new Board Room done by June 17, 2013. Jeff Morish said it could not be done. At this time, the Supervisors had not budgeted a dime for this folly.
Kan We Help requested a copy of this "study" and was told that it did not exist
On December 10, 2013, CAO Martin Nichols presented a "Reassignment of Courthouse Space" to the Board of Supervisors.
Martin Nichols tells the Board "at such time as the remodeling costs are known, the Board will be advised of that determination and be requested to appropriate those expenditures
At the January 21, 2014 Board of Supervisors meeting, Chapman now wanted a Task Force Committee to be formed. Chapman never mentioned bringing back any previous Task Force. This new Task Force would be chaired by him and members would be hand picked by him. Chapman claimed that this new Committee would be tasked with moving County Staff efficiently into available spaces in the old Courthouse and Courthouse Annex. Chapman promised that the "COURTHOUSE SQUARE REVITALIZATION TASK FORCE COMMITTEE" would recommend what needs to be done with the vacant spaces.
THIS COMMITTEE NEVER MET AND WAS DISBANDED IN 2015
On March 11, 2014, the Board of Supervisors set aside Chapman's Dreamcicle Board Room.
On April 14, 2014, new CAO Richard Egan claimed that he was going to receive a "NEEDS ASSESSMENT STUDY" in a few weeks and told the Board that rather than spending money to remodel the vacant spaces, it might be possible to buy the BLM building on Riverside Drive. Kan We Help requested a copy of this study and was told that it was not disclosable.
The 2015/2016 Budget (July 1, 2015 to June 30, 2016) did not include any money for remodeling the Courthouse/Annex projects. Previous and present Board members have said many times that a Master Plan must be in place before this EXTENSIVE movement of county offices. NOW, before ONE DOLLAR is spent on the new Riverside building, Chapman now wants to spend $133,000 on a study for his New Board Room, up those stairs, in the Old Courthouse.

The Lassen County Supervisors eventually purchased the BLM building by borrowing $4.1 million. The Supervisors have no idea how much "fixing" this 1996 building will cost, plus moving costs, plus new furniture, fixtures. After transferring $1.1 million to the JPA for the community pool there is less than $1.5 million left of the loan.
Over the years, Chapman has made many attempts to get "new digs". The Supervisors have placed this issue on the December 15, 2015 Agenda to spend $133,000 just to look at the possibility of building a Board Room in the historical Court.
AFTER THE BLM BUILDING IS REMODELED AND OCCUPIED SOME TIME NEXT YEAR, THEN AND ONLY THEN SHOULD THEY consider

Eventually, if they can find the money, the most efficient and convenient space to move the Supervisors Board room is the 2600 square foot Auditors office in the County Administration building on Roop Street. The Auditor could relocate directly below in the space vacated by the Public Defender.

Lassen County Supervisors receive an additional pay increase they just don't want to talk about which pays them thousands of dollars above the Statutory Salary

They spent $ 1.4 million on a building (2950 Riverside, Susanville)
The Supervisors have no idea how much they will need for the repairs, remodeling and the cost to move four county departments in to it (District Attorney, Public Defender, Child Protective Services, Probation Department)
With less than $1.5 million left [of the$ 4.1million loan], Chapman pushes his new Board room up so he can "hold court" in it before he retires at the end of 2016.

Supervisors Pyle and Chapman attempted to claim again they had not received any pay increases since 2002 but had to take back that statement when the Auditor confirmed they had received a pay increase in 2013
Reluctantly, the Supervisors approved an Ordinance that would give them their pay raises when County employees were scheduled to get contractual pay raises.
The idiot "25% of a judges salary" clause was removed.
The Supervisors can use that $37,260 pay rate set in the 2015/2016 Budget to pay for the first two increases.
Supervisors Pyle, Chapman, Albaugh and Hammond still receive more than the statutory pay now !

Richard Egan stated that he tried to set a Lassen Modoc Flood Control District Meeting for December 10 in Adin, Modoc County. but the Modoc County Supervisors could not attend. Egan claims he is going to try and set the meeting on December 17, 2015. That meeting will be cancelled also.
THE PROBLEM:
Egan said that he plans to hold the Flood District meeting, in Modoc County and then adjourn to reconvene an illegal Lassen County Board meeting in Modoc County.

Expansion of the Beiber Family Resource Center (One Stop)
A 2009 Lassen County capital improvement project that is yet to be built even though the States $788,000 Grant money still sits in the bank to expand this facility.
This project had no fiscal impact on the General Fund. This CIP was funded through the Mental Health Services Act and the Supervisors continued to waste this Grant money .
At the May 12, 2015 meeting, the Employees at the three Family Resource Centers (Beiber, Herlong and Westwood) asked for help. The One Stops currently get $10,000 support from the Supervisors.

"Bob Burns: The Dark Stinky Stain on the County"
The Lassen County Supervisors decided to hire the sitting District Attorney Bob Burns as their new County Counsel when the current County Counsel Retta Vander Ploeg gave her notice. The Supervisors decided to hire Burns at an out-of-town meeting, out of Susanville. This meeting was held in Bieber. No audible motion was made to hire him and yet the Supervisors signed his contract on May 16, 2014.
On September 24, 2013, Tom Hammond was seated after District 5 Supervisor Jack Hanson was recalled.
Tom Hammond was Lassen County Vendor #611 when he was seated on the Board of Supervisors. Hammond knew that he was doing business with Lassen County for years and it would be a conflict if it was not disclosed. Over the next two years Supervisor Hammond continued to do business with Lassen County, a lot of business.
Burns said nothing, Egan said nothing. HAMMOND SAID NOTHING, until inquiries were made about the conflict of interest.

CAo Richard Egan never brought this issue immediately to the Board when he was hired on February 25, 2014. Egan was Lassen County Treasurer, and long time resident, prior to being hired by the Supervisors as County Administrative Officer.
For the past two years Tom Hammond has continued to violate the FPPC rule that requires the Board of Supervisors to "ratify" doing business with Supervisor Hammond
Supervisor Hammond did not disclose to the FPPC that he was doing business with Lassen County. The FPPC fined Supervisor Hammond $2500 for voting on the Pezzullo Herlong Sale and had this been disclosed the FPPC would have fined Hammond over $5,000.
Agenda H-4 was placed on the October 13, 2015 Board of Supervisors Agenda [see 10/17/15 post below] to allegedly give CAo Richard Egan special authority to approve spending over $25,000 for 14 accounts (Totally unnecessary due to budget restrictions already in place). Suddenly Cao Richard Egan advises the Supervisors that they should take a separate action on Supervisor Hammond's business. The vote was unanimous to continue doing business with "The Mark" (Hammond's business in Herlong). This vote should have been made the day Supervisor Hammond took office (9/24/13) two years ago when County Counsel Vander Ploeg was still there. Vander Ploeg is the "attorney" that advised Tom Hammond that he could vote on the Pezzullo/Herlong sale. A vote that cost Supervisor Hammond a FPPC $2500 fine.
NOW........County Counsel Bob Burns advises the Supervisors that under Government Code 1091 (c) 8 a majority vote must be taken for Lassen County to continue doing business with Supervisor Hammond

On October 27, 2015 Kan We Help advised the Supervisors, in writing, that the County Clerk had changed this erroneous code, 1091 (c) 8 in the October 13, 2015 Minutes to 1091/1091 (b) 8. The Supervisors, after Kan We Help disclosed the error, passed the Minutes without correcting the Minutes.
NO FPPC LETTER EXISTED
The Supervisors never discussed correcting the Minutes. Burnsfake code was changed to 1091 (b) 8.

He and Bob Burns told the Lassen County Supervisors that the five Lassen County Supervisors would qualify as a quorum as determined by their alleged 9 member Board.
Burns, Egan and Chapman are attempting a very deceitful act.
John Benoit of LAFCO, provided Kan We Help with a copy of the "Act" that created this District.
The Supervisors District's, in both Lassen and Modoc County's, must be within the territory of this flood district, to be on the Flood Board.
At the time this was discussed there could have been 10 members on the Flood board. Re-districting in Modoc County included Supervisor David Allan.
The issue for Lassen County is that the Big Valley watershed is in limbo.
As always, Chapman mis-spoke about the events surrounding Kan We Help contacting Modoc County CAO Chester Robertson. Evidently Chappy was in Modoc County at the time Mr. Robertson spoke with Kan We Help's Secretary Eileen Spencer and revealed that Chapman got stuck in their elevator.
Modoc County is very concerned about the "Bully" behavior of Lassen County.
The issue came up when Richard Egan stated that he was setting up a meeting of Lassen County Supervisors in Modoc County. The Brown Act does not allow them to hold a meeting outside of their jurisdiction with the intent of adjourning their meeting to hold a Lassen-Modoc County Flood District meeting.
However the "two county" board could meet after a proper Public Notice to conduct only the business of the District. The subject matter that the Lassen Supervisors want to discuss is not within the jurisdiction of the Flood Board.

HLVRA's Unprofessional Speculations
May Prove Too Costly Too Build the Pool
The HLVRA Board of Directors would not listen to those professionals that strongly suggested getting a set of Plans done a year ago.
In fact, that was their original goal
This stumbling Board has now issued two RFP's. The second RFP included a Gross Maximum Price of $2,249,866 to design and build a community pool.
Unfair to any Contractor, this HLVRA Board voted to amend the GMP to $3,000,000 so they can sign a contract with Modern Building...........
How many ways is this JUST WRONG ?
This pool cannot be built for $2.2 million but the HLVRA Board was told this over and over.
Even though the second RFP clearly stated the GMP, only two Contractors Bid in an illegal and unethicalsecret bid opening. Modern Building bid $2.9 million and Tricon bid $3.3 million
The Board voted to sign a contract with Modern Building and try and scale down the pool because they do not have $3,000,000.

Burns supported the same rental to attorney Chip Chittock and had no problem with Chittock having direct access to the District Attorney's offices.The DA is currently housed adjoining the old courtroom upstairs. Chittock has yet to give a date to the County for the "rental". KWH was turned down for the rental because no date was given.
Supervisor Chapman chimed in and agreed with Bob Burns that it would be a liability to have the Kan We Help people or the public traipsing up and down those stairs.
The old courthouse has never been ADA compliant. But the other 2 story County buildings have never been ADA compliant either. Chapman only wants to put a $500,000 elevator in this building so that he can spend $1,000,000 on his new Board of Supervisors Board room in the historic courtroom.

District Attorney's Perjury/Voter Fraud Case
Against Lassen County Assessor
The District Attorney's political vendetta against Lassen County Assessor Dan Schlueter ended this afternoon when Schlueter's attorney Stephen King proved that his client did not commit perjury.
Steve Pezzullo lost his appeal to lower his Herlong properties tax bill. Pezzullo paid his taxes in full on March 11, 2015 and then shortly after, according to Deputy McGarva's testimony, an "anonymous" voter fraud/perjury complaint was filed with District Attorney Stacey Montgomery.
Pezzullo's attempt to acquire Herlong's Amedee Army Airfield was foiled when the Assessor assigned Parcel numbers to the Airfield. Lassen County Supervisors attempted to include the East end of the Amedee Airfield to Pezzullo when they gave him the 3,000 acres of public land.
In an earlier sale to Pezzullo, the Lassen County Supervisors succeeded, in including the "One Stop" building in Herlong. Pezzullo gave the building back to the County when he found out that he would need to bring the building up to ADA compliance before he could sell it.
PEZZULLO & MONTGOMERY ATTENDED THE COURT HEARING TODAY
DA Montgomery's lead investigator, Undersheriff John Mineau, told the DA that Dan Schlueter did not live in Clear Creek (Lassen County) because Schlueter could not have lived in an "uninhabitable" trailer on his property. DA Montgomery did not present a single witness that could verify this assumption. She relied totally on the statements by Officer McGarva and Undersheriff John Mineau (Mineau did not testify and was not present in the courtroom). King, on the other hand, provided five witnesses that rebuked McGarva's testimony.
Dan Schlueter's attorney Stephen King presented a brilliant defense that proved that the Assessor lived in Lassen County prior to filing his candidate papers to run for the seat being vacated by long term Assessor Ken Bunch.
Montgomery leaves the courtroom vowing to contact the Secretary of State ???????

PGE Lake in Westwood
According to Paul Moreno, a PGE Media representative, Mt. Meadows Reservoir was drained due to the fact it was not maintaining a level needed for hydro-power. Mr. Moreno stated that no other lakes in the area were effected.
Rumors that it was an accident when a valve was un-clogged by a Fish and Game biologist are not true. PGE has been monitoring the lake levels daily for some time. Paul Moreno stated that all of the creeks feeding Mt. Meadows Reservoir have dried up and the little water left was not supporting the fish population.

Sheriff Growden initially spoke at the June 23, 2015 Board of Supervisors meeting wanting to use the Westwood warehouse at 463-475 Birch Street in Westwood. He then spoke on September 15, 2015 and stated that the Sheriff's Department could pay back the $50,000 RBEG Grant ( Rural Business Enterprise Grant)
Probably, the extra $50,000 the Sheriff found can be used for a better purpose
Lassen County used a $50,000 RBEG Grant (obtained through the USDA) to renovate this building and it can only be used for small and emerging private business enterprises with less than 50 employees and less than a million dollars in gross revenues.

On May 19, 2015, Public Works asked the Board of Supervisors for authority to purchase a warehouse that sits on 3.48 acres in Westwood. The Supervisors approved this purchase and paid Ryan Real Estate Appraisers $3500 to appraise this property. This Warehouse is less than 2 miles from the Birch Street warehouse property.

PGE drained the lake dry over the week end. Walker Lake feeds into Lake Almanor
This once beautiful serene Lake is now just a stinky mud hole. The hundreds of fish that made it through the dam struggle to breath in the pond of water left below the dam.
PGE will not comment on why Walker Lake was completely drained.

Kan We Help used Lassen County's 2007 Budget as a baseline to investigate why the Board of Supervisors annually claim they are broke. What we found was not surprising. The Supervisors tuck millions away, each year, in their Budget in barely used and basically innocuous accounts. [UN-NOTICED ACCOUNTS]. Kan We Help identified 45 accounts that are used and these phony expenses stay there year after year and are never used. The purpose: To create the illusion of a deficit.[Study used 2007-2014 Budgets]
The Lassen County Supervisors 2014/2015 Budget hid over $3,000,000 in their budget in accounts that were never going to be used.
The Independent Auditor disclosed their secret last year when they announced the County had a $4,000,000 surplus.

The annual Budget meetings (which are public meetings) concluded this week. These meetings are simply held to bully and intimidate County Department Heads. CAO Richard Egan told Staff (not all attend the Wednesday meetings) that the County had a $318,000 deficit.
The Department Heads have succumbed to this intimidation for decades. It results in huge overtime expenses because of staffing that Supervisors have refused to allocate money for.
CAO Richard Egan had the audacity to ask DA Stacey Montgomery if she would accept a .8 employee instead of a 1.0 employee. Her Budget Request for an additional attorney and Investigator fell on the Deaf/Dumb ears of Supervisor Chapman and Pyle.
The County has more than enough money to accept
all of the Budget requests of all County Departments
The two Supervisors (Chapman & Pyle) made very inappropriate comments about the Assessor and said that if you are not here you lose. They kidded about not giving the Assessor the Appraiser that is badly needed (Re: Williamson Act Abuses & Compliance against the ranchers)
Supervisor Chapman was against free food for the poor and wanted to give the One Stop in Herlong more money and said the Bieber and Westwood One Stops should raise their own money. Chapman resented the annual dinner the One Stop provides and said it should be a "POT LUCK". Chapman was concerned that the County doesn't even know "how" the annually allocated budget ($10,000) was spent.
.....and yet the Supervisors tell the Chamber of Commerce....HOW MUCH DO YOU NEED AND WRITE THE CHECKS WITHOUT ANY ACCOUNTABILITY (the donations to this private political company are absorbed in the General Fund).
Why: The Chamber of Commerce represents VOTES

LCAC Supervisor Pete Heimbeigner never even introduced the shelter staff and took the credit for it's successes. Mr. Heimbeigner told the Supervisors that licensing dogs has made the difference. The Staff sat behind him at the meeting and was never introduced or called on to tell the real story of the "successes"
Public Works Director Larry Millar, in a letter to the Supervisors, was the only one to acknowledge that the difference was due to the shelter staff and their hard work

They are heroes.
They save animals everyday of the week and do not EVER get the credit for their dedication and commitment for finding homes for the discarded "pets" in Lassen County that would normally be euthanized.
Five years ago the "County Pound" was killing two dozen adoptable dogs a week, almost every dog that came into the "Pound". No attempt was made to find homes. Now, the euthanasia rate is less than 10% and these are done because of a court order or due to illness.
In 2014, 690 dogs came through LCAC, 242 dogs were privately transported to No-Kill rescues. 89 were adopted and 269 were returned to their owners.
This success can only be attributed to the four individuals above and we all thank them

The Lassen County Board of Supervisors Consent Calendar Agenda is reserved for routine items of business. CAO Richard Egan placed a "Rental Agreement" in the Consent Calendar that would rent the historic upstairs courtroom to a private attorney. This courtroom is coincidentally next to the District Attorney's office. Richard Egan claimed, at the Board Meeting, yesterday that Mr. Chittock would be using it after hours. The Treasurer, Assessor, Elections and Recorders offices are also in this building. There is no security in this building.

Kan We Help suggested that if Mr. Chittock needs additional space that he could rent the empty house next to his office building or rent one of the many many empty buildings in Susanville. Judge Sokol's ground floor courtroom is vacant and is not connected to any other County offices
Supervisor Albaugh questioned the logic in renting the courtroom to Mr. Chittock. CAO Egan only then revealed that it was only for one day. Chairperson Bob Pyle asked for a motion and the other four supervisors were silent. After an awkward pause Supervisor Hammond made a motion to approve and then there was no "Second to his Motion". After another awkward moment Supervisor Hemphill seconded Hammond's motion to approve Chittock's Rental Agreement. The Courtroom is now available to the public...........
The vote was unanimous to allow a private attorney access to the County offices after hours.

The Ugly Reality of Lassen County Politics
HSP Resources (aka Hayes, Smith, Pezzullo) were promised the Amedee Airfield and didn't get it. The Amedee Parcels RFP was "rigged" from day one.
The Army holds a 50 year lease for the Airport with Lassen County. If the County sells the leased property (which they attempted to do), the new owners (HSP) would now own the Airfield.
This attempt failed and Pezzullo wants someone to pay ?

Judge Verderosa was no where to be seen. Stephen Bradbury appeared at the bench to the surprise of "everyone", including the Bailiff who told visitors that Judge Verderosa would be presiding over the hearing.
No reason was given for the substitution but Bradbury ruled that there was sufficient cause to hold William Romero for the murder of Angel Siler in 2011.
Prosecutor Dan Howe, at no point appeared interested or competent at the hearing.
Howe either has no skills to prosecute a murder trial or he has been distracted by the enormous responsibility of his new appointment as "Hearing Officer". Bob Burns just gave Howe a $5,000 contract to act, when or if, a marijuana dispute arises. The $ 5,000 appeared to have the perception of a bribe. A bribe to sabotage the Romero trial perhaps. Burns was the District Attorney when Angel Siler was murdered and he did nothing.
After today's performance the District Attorney should be looking for a Special Prosecutor.
An arraignment date was set for July 16, 2015 at 1:30 PM in Judge Verderosa's Court

The Board of Supervisors voted to approve the 2015/2016 Budget on June 23, 2015 which included the purchase of the BLM building.
The County's $4 million dollar loan ($1.7 BLM bldg, $1.1 pool, $1.2 to conceal) was deposited in the Lassen County Treasury on June 4, 2015 so that on July 1, of the new fiscal year, they could purchase the BLM building.
The CAo Richard Egan planned on spending $1.1 million for the building but the final purchase price was $1.3 million, leaving an alleged $400,000 for repairs and remodeling of the new building.

These two men attended the June 16, 2015 HLVRA meeting when the Executive Director Jarod Hancock announced that Susanville did not get the OGALS Grant. The OGALS Grant, if awarded, was to be used for Susanville's share ($1.1 million) of the construction costs for the community pool. Susanville must now find another source for the pool construction costs.
The County will hold onto the $1.1 million that they borrowed on June 4, 2015 until Susanville can find a source for the pool construction costs.
Chapman and Hammond stated clearly that this Grant had nothing to do with the pool.

LMUD fired Frank Cady when it became evident that Cady's activity could no longer be tolerated. Frank Cady placed "FOR INFORMATION ONLY" after each Lassen Municipal Utility District's Agenda items and told the public that they could not comment on these items. Kan We Help challenged this change because it was illegal and convinced the LMUD Board to cancel this policy.

Frank Cady's BFF, Bob Burns is moving in that direction when he told the Lassen County Supervisors that this is THEIR MEETING AND NOT THE PUBLIC'S. Burns suggests not letting the public comment on certain Agenda items (illegal).
Burns told the Board of Supervisors that the public should not be allowed to comment on approving the Agenda or past Minutes.
Burns told the Board that the public should not be able to pull "Consent Calendar" Agenda items, even though the Board's procedures allow this. The Consent Calendar is supposed be used for routine business but this Board every week abuses this and places inappropriate items to be approved without discussion by ONE SWEEPING VOTE.
Burns told the County Clerk not to release LCPIC public records to Kan We Help but later changed his mind when Kan We Help threatened to file a Writ of Mandate. Burns only released a portion of the Lassen County Public Improvement Corporation documents. CAO Richard Egan has been paying this shell corporations annual fees from the Chamber of Commerce's account for years without consent from the Supervisors.

City of Susanville Fails to Get the $1.1 Million Dollar Grant for
Construction of the
Honey Lake Valley Recreation Authority Pool
Lassen County Supervisors and the only incorporated city in the County, Susanville, formed a Joint Powers Authority in 2013 to build a community pool.
The HLVRA moved forward today and approved a Request For Proposal (RFP) to find a developer or contractor to build the pool even though there are no funds yet.
The two public entities have each been contributing $200,000 a year to the HLVRA towards the construction costs.

The County Clerk claimed later, after Kan We Help threatened to file a Writ of Mandate, she had to find all of the documents requested.

Gullerod is currently delinquent $13,174.31 on the property Lassen County CAO Richard Egan has been trying to purchase for Lassen County. The delinquent taxes have never been mentioned at any public meeting. She also paid a penalty on her tax bill in 2014 but has paid the December 10, 2014 taxes.

A Ukiah resident, Tony Shaw, was hired to put this $4 million dollar loan together. The Board of Supervisors hired the Government Financial Strategies Inc. and GFS, Inc. based their vetting of the LCPIC to receive millions on Bond Counsel (Meyers-Nave). .....great checks and balances ?
Lassen County Counsel Bob Burns has blocked any disclosures on the LCPIC that was formed in 1998. He advised the County Clerk not to release mandatory State annual reports, Agendas and Minutes. All are public documents.
All corporations in California are required to comply with the changing corporate laws. LCPIC is no exception, even though the GFS, Inc. was told by Bond Counsel that the LCPIC does not have to comply.
BOTTOM LINE:
Is the LCPIC really defunct and is being resurrected?
Will most or all of the 4 million be used on the DA's new building?

The Lassen County Supervisors are using Frank Cady's Meyers-Nave law firm to put a similar deal together. If it worked once, why not do it again?
This alleged agreement is half ass backward
and suspect as to intent.
Meyers-Nave refer to the "Riverside Building" and "Lassen County Courthouse" as though they are the property of Lassen County.
The deception is quite intentional.

If the BLM building [on Riverside Drive] is connected to Steve Pezzullo, will the price be inflated or doubled? If the price is doubled and CAO Richard Egan is authorized to pay $2-2.5 million for the BLM building what money is left of the $4.1 million? They will need $1 million for renovations.
The BLM building is being purchased for the new District Attorney and related departments. The District Attorney is presently housed upstairs at the old courthouse building vacated by the State of California when they built the Lassen County Courthouse on Riverside Drive in Susanville.
There will be no money left for improvements at the old courthouse on Lassen Avenue in Susanville after the BLM purchase and renovations and the gift of ???? dollars to the HLVRA. There will barely be enough to give to the Honey Lake Valley Recreational Authority for the construction of their community pool project. The HLVRA was relying on the Tobacco Settlement annual contributions to pay for the $400,000 anticipated maintenance cost. With this new scheme, all of the Tobacco Settlement money will go to the Lassen County Public Improvement Corporation FOR " RENT?.

In September 2011, Angel Siler was found near death by Susanville Police Department and Fire personnel. The medics reacted with professionalism and respect, rushing Angel to the hospital. The Susanville Police were another matter, the obvious lack of professionalism and courtesy is very evident in the responding officers behavior. He did not call for a detective or crime scene technician. Nor did he even consider the possibility that Angel Siler could have been forcibly drugged and raped.
Her nude body with bruises was clearly evident and the Susanville Police Officer took no action. This beautiful young woman alone, nude, incapable of speaking and surrounded by 3 men, the buffoon of a police officer did nothing to investigate.
Angel was buried after a brave unsuccessful fight for her life several days later, with the evidence of what happened to her in that dark shack on 2nd Street, in Susanville, minutes from the Susanville Police Station.
Now 5 years later the Susanville Police Department's knee jerk reaction is to arrest one of the men in hopes of keeping the Archangels of Justice away. We had the medical reports, statements and photos of Angels bruises. All of her bruises are consistent with being forcibly held down. The case was simple 5 years ago, but no one in law enforcement cared and apparently neither did the District Attorney Robert Burns
Now they clamor to arrest, make a media splash and cite how complex a case it is. Once again the propaganda spews forth. The Susanville Police Department in this county today are very well aware of proper protocol, and the possibility of rape during drug use. There is no excuse for their past shoddy police work. There is less of an excuse for the Chief of Police to try to cover it up. If he had any guts or integrity he would push for charges against the Officer for neglect and dereliction of duty.

A County owned building that was maintained with state and federal dollars was intentionally given away. Today, there is still not a single piece of paper that stated the Supervisors wanted to keep this building and yet the Supervisors continue to tell the public that it was a "mistake". The Pezzullo group gave the property back after realizing that they would have to spend hundreds of thousands in ADA improvements in order to sell the building.
One Stop Center in Bieber
A 2009 Lassen County capital improvement project that is yet to be built even though the States $788,000 still sits in the bank to expand this facility. This project had no fiscal impact on the General Fund. This CIP was funded through the Mental Health Services Act. THE SUPERVISORS HAVE DONE NOTHING
Amedee Airport Runway
County Supervisors intentionally included, in the sale to Pezzullo, the East End of the Airfield but the County Assessor will assign Parcel Numbers to the Airfield so that it cannot be included in the sale to Pezzullo
The price of doing this may cost the County an Assessor and a Surveyor
With every breath in their bodies, the Lassen County Supervisors stated that they were not going to sell the Amedee Army Airport and then attempted to include the east end of the runway in the sale to the Pezzullo group. Literally for months, Kan We Help has been demanding that the $350,000 bad loan to Medici Logging be placed on the Boards Agenda. CAO Richard Egan and County Counsel Bob Burns refused to place the December 8, 2014 Medici Logging Bankruptcy on the BOS Agenda, claiming there was nothing to tell the public.

Lassen County Grant Manager, Jenna Aquilerra, told the Board of Supervisors that any time Medici Logging did not maintain the "Public Benefit" requirement, Lassen County would be at risk of returning the $350,000 CDBG money to the State.

included the information that Medici Logging had a $1,000,000 loan outstanding with Bank of Commerce. According to the author of this Credit "analysis" (3/20/15) the Lassen County Supervisors all knew about the Bank of Commerce loan.

Mr. Reger confirmed that the Auction the Court ordered of the estimated 75 DMV registered vehicles owned by Medici Logging Incorporated brought only $211,000 back to the Court. Mr. Reger told Kan We Help that all of this money will go directly to the Creditors.
The $19,000 Lassen County back taxes [owed by Medici] will be paid from the net amount of the auction held on April 2, 2015 by "West Auction".
Bank of Commerce filed their UCC form on May 16, 2012 for 100% of the secured Medici equipment & inventory, according to "Lead Attorney for Bank of Commerce" Andrew Reisinger. This puts the Bank of Commerce in first position to the equipment & inventory.

at the Board of Supervisors meeting on April 21, 2015
Lassen County is a "debt free" County and has had a comfortable $4,000,000 surplus for several years now. Deputy CAO Tony Shaw [a Ukiah resident] brought a contract to the Board of Supervisors to find a revenue source for the construction costs of a community pool, remodel the old Courthouse (a Jim Chapman pet project) and to purchase the recently vacated BLM building in Susanville.
BIG PROBLEMS
1. The Supervisors want to "lease"and remodel the BLM building from a local CPA's relative
2. The County gave away the property the pool is on so it cannot be financed through a COP. CAO Richard Egan has stated many times that the swimming pool is not on the Capital Improvement Plan because it is not owned by the County.
When Kan We Help told Ms. Raineri the County does not own the pool, she suggested putting the Jail up for collateral. She said that the County would not default on this loan because they needed the Jail.

"Seat at the table speech"
The Plumas County Supervisors placed the "State of Jefferson" issue on their April 14, 2015 Agenda for discussion only. The 37, in the audience, were split in the middle as far as the support for and against seceding from the State of California.
The Jefferson presentation was tailored for Plumas County, however Supervisor Lori Simpson had done her homework and she takes copious notes. Mr. Baird was not prepared to answer Supervisor Simpson's challenges but said he would be happy to meet with her.
Lassen County Supervisor Chapman did his homework and had ripped the SOJ financials during the last presentation in Lassen County.
The financials presented to Plumas County had changed from the Lassen County presentation. SOJ's Mr. Baird now told the Plumas Supervisors that the new state would likely incur a half billion dollars in debt when they broke away from California. He also told Supervisor Simpson that the Counties would basically be on their own in the new state and reduced the new Jefferson State government to an as needed "consultant". The new state would have no credit rating and would most likely have a Junk Bond status.

These Jeffersonians love government. They have no problem with government. The issue is that they hate DEMOCRACY. These Jeffersonians only want their conservative expression and point of view to be the cornerstone of their government.
Why else would they want to repeal REYNOLDS VS SIMS. This ruling by the US Supreme Court established EQUAL PARTITIONS OF LEGISLATIVE DISTRICTS.

Democracy is a very messy process. It requires that the REPULSIVE and DISGUSTING right of freedom of speech, expression and thought be instituted into your government.

The motivation and undercurrent of the Jefferson proponents is the fact that Lassen County, rural and sparsely populated, is an island of conservative Tea-Publicans. The Tea-Publicans have shown only the ability to disrupt and distroy. They have never shown an ability to govern.

GENTLEMEN: "We" have been observing your ranching and farming operation for 73 years and we have assessed that we can better represent the operation f your lands than you have individually and collectively demonstrated.
Therefore, we intend to assume complete possession of your lands to better represent what "WE" believe your lands should be.
"WE" now demand that you relinquish ownership of your real estate, including all buildings/facilities that are located within Lassen County. No compensation will be given to the property owners for the land or improvements.

The Supervisors spent over $12,000 on a Credit Report. On March 24, 2014 (when the loan was approved) Medici Logging had a $1,000,000 loan outstanding with the Bank of Commerce in Redding. Public Records show that Plumas Bank Executive Joe Egan had the Medici equipment appraised for liquidation in 2010.

The audio and video of the February 10, 2015 meeting shows Supervisor Pyle taking an action in "Public Comment", which is prohibited by the Brown Act.
The Minutes for 2/10/15 stated, in fact, that an action was taken in "Public Comment"
Only the February 10, 2015 Meeting Minutes were placed in the "Consent Calendar" (G-6). These items are passed by a single vote unless pulled for discussion. The other three minutes were placed as an individual agenda item H-1.
County Counsel told the Supervisors that they didn't have to attend the meetings to vote on approving the Minutes for their accuracy. The Supervisors knew better and ignored Burns advice.
NOTE: Susan Osgood, Deputy Clerk of the Board, also omitted all of the actual
public comments that were heard that day. KWH has stopped counting the volume of mistakes made by Ms. Osgood.

over the Brown Act ?
On March 3, 2015, the Board of Supervisors called a Special Meeting due to errors they made in the Emergency Medical Services RFP. There was only one agenda item and two public comment agenda items.
Agenda Item B 3: Public Comment
Barbara Howe addressed the Board (in "public comment") on the RCD members the Board appointed in 2014.
She was abruptly interrupted by County Counsel. Burns, who in the past has never shown any knowledge and total contempt of the Open Meeting law (Brown Act), told Ms Howe that this was not in the jurisdiction of the Board of Supervisors.

Maybe, just maybe, if Bob Burns had waited just a few minutes longer he wouldn't have lobbed his objection.
The curious thing that happened next was Supervisor Chapman chimed in that Public Comment could be about anything and it didn't need to be within the jurisdiction of Lassen County.

Every Agenda shall provide an opportunity for members of the public to directly address the legislative body on any item of interest to the public, before or during the legislative body's consideration of the item, that is within the subject matter jurisdiction of the legislative body.
Burns was out of order by objecting to Barbara Howe's public comment but Chapman was out of order by claiming that public comments didn't have to be germane to the jurisdiction of Lassen County

Chapman is also a member of the HLVRA (pool JPA) and attended their 3:00 meeting.
After several attempts (and no success) to get the HLVRA Agenda's posted to their website, KWH Secretary presented the HLVRA with a written Brown Act Violation.

Coincidentally, this four year old appraisal was used for the approval of the March 24, 2014 Lassen County $350,000 CDBG loanand the December 8, 2014 Bankruptcy Court.

On May 28, 2010, Plumas Bank recorded a $125,000 loan to Medici Logging for the 69 Delwood, Westwood property

On May 16, 2012, the Redding Bank of Commerce approved a $1,000,000 loan for Medici Logging based on the Plumas Bank (Joe Egan) appraisal of $1,452,300.00 for the Medici equipment.

On March 24, 2014, the Board of Supervisors unanimously approved a $350,000 CDBG loan for Medici Logging when they knew that this company's debt, on March 24, 2014, was greater than their assets. In other words, there was a ZERO chance of this loan being paid back

Medici Logging had an existing loan for $1,000,000 with the Redding Bank of Commerce at the time Lassen County approved the $350,000 CDBG loan.
The Bank of Commerce loan was issued on May 16, 2012. The Bankruptcy documents also show that the collateral Lassen County used to protect its' loan was already used by the Bank of Commerce.

of Wrong Doing...ABSOLUTELY
HSP Resources (Hal Hays, Larry Smith and Steve Pezzullo) stated in their 12/8/14 proposal that they were in negotiations with the Depot. Hal Hays purchased the land above these parcels for $450,000 so that he would have access to the airfield before the Amedee Airfield Parcels RFP was issued. He's offering $25,000 for the parcels.
Herlong could have used an investment of $450,000. Pezzullo bought the town for $31,900.
Hal Hays stated, on February 10, 2015, that he could bring in UPS, FEDEX and other carriers to share the Army's Airfield. The airspace above Amedee Airfield is Federal airspace. As long as Sierra Army Depot is open that airfield will not be shared with any private entity.
The Supervisors refused to order the Airport Land Use Plan ($40,000) which is mandatory before giving this property away for $35,000.
Who would buy any land when the "use" of the land is undetermined.
Sharp Army Depot had the same problem as Sierra Army Depot.....contaminated land
Sharp Army Depot put up LUC (Land Under Control) signs around the contaminated land and continue to do clean up on water contamination.
Sierra Army Depot got rid of their contaminated land ( by transferring it to Lassen County) but left $4,000,000 worth of clean up (unexploded ordinances, chemical contaminations).

The last two "Special Meetings" (January 29, 2015 & February 4, 2015)just happened to coincidentally follow the court filings of Federal case 14 cv 01473. The same case that Margaret Long is defending for Lassen County.
Kevin Jones, Burns old bodyguard (?)and recent new Captain (?) at the Sheriffs Department, was served this lawsuit on June 4, 2014.
Bob Burns resigned as District Attorney on June 9, 2014, deliberately leaving this mess
to Stacey Montgomery.

California Government Codes 25100 and 26801 clearly state the County Clerk shall act as the Clerk of the Board. However Government Code 25100.5 states that the Board of Supervisors can appoint the Clerk of the Board by enacting an Ordinance. By enacting an Ordinance, the Supervisors brought this statutory position under the supervision of the Supervisors but when the former County Clerk did not run for re-election they repealed this.
For seven years 15% of Julie Bustamante's check is paid from the "Clerk of the Board" annual budget. She gets paid 15% as County Clerk, 55% as Election officer (1 maybe 2 elections a year) and 15% for County Recorder.
Susan Osgood, is acting as the Clerk of the Board.
Budget for this statutory position
This Statutory position, Clerk of the Board, has defined duties which include attending all regular and special meetings (Gov't Code 25101 (a)), keeping the Minutes in all formats (Gov't Code 25101 (b)), deliver to the Auditor all demands for money (Gov't Code 25101 (c)), file and preserve all documents submitted at the meetings (Gov't Code 25101 (d)) , authenticate signatures, placing the "Seal of the Board" on documents.
From 2007 to September 23, 2014, the County Clerk has placed the Minutes of Supervisors on the Agendas.
12 times, in 2014, the County Clerk did not place any Minutes on Agendas and fell incredibly behind. The Minutes that were submitted for approval were chronologically all over the board.
On January 27, 2015, Supervisor Chapman told KWH that it was none of our business.
On the October 14, 2014 Agenda, Julie Bustamante began placing the Minutes
under "County Clerk/Recorder".
On January 27, 2015, County Counsel omitted the statutory "Clerk of the Board" position all together on the 2015 Conflict of Interest Codes.
KWH challenged the COI as Deficient
Bob Burns does not have the authority to dismiss a position that has been created by Government Code 25100 nor does he have the right to create fictitious departments
The former County Counsel Vander Ploegg also attempted to create a fake title, "Chief Financial Officer", and KWH made them change it back to CAO.
Yesterday, Kan We Help notified Bustamante that the January 13, 2015 Minutes posted had not been approved by the Board of Supervisors.
Bustamante, without checking, quickly answered back that we were "WRONG AGAIN". Kan We Help asked for a date where the 1/13/15 Minutes had been approved. Bustamante did not apologize but did take the Minutes off the website.

1. The Clerk of the Board is a statutory position and was deliberately omitted by County Counsel. The County Clerk has failed to be competent in this position. Kan We Help suggested moving the "Clerk of the Board" position back directly under the Supervisors authority and supervised by the CAO. Government Code 25100 allows for this change. This position has been budgeted so there would be a negative impact on the budget.
2. There is no "County Clerk/Recorder" position. The positions that are budgeted are Clerk of the Board, County Clerk, County Recorder and County Elections.
3. There is no Public Works Department. County Counsel simply copied the last COI without reviewing if this position even existed. The Transportation Department has a budget.
4. Both County Counsel (Title 2, Section 2.08.30, m208.040) and District Attorney (Title 2, Section 209.010) are named as "Public Administrator" in Lassen County Codes.
5. The Board of Supervisors voted to add a budget for a new Department Head on June 10, 2014 (Deputy CAO). The CAO hired a Deputy CAO on January 5, 2015 but this position never came before the Board for approval.The CAo has kept him hidden ???????

Burns placed a new legal contract on the January 20, 2015 Board of Supervisors Agenda (H-2).
Burns told the Supervisors that he wanted to cancel the Cota Cole contract immediately and hire a new law firm called Prentice Long and Epperson LLP. This law firm was recently formed in December of 2014. County Counsel Burns did admit that Margaret Long was a friend of Rhetta Vander Ploegg (former Lassen County Counsel).
Margaret Long suddenly left the Cota Cole law firm to form this new law firm with Jason Epperson and David Prentice.
We don't know if she was fired or left before she was fired.
During the H-2 Agenda discussions, Kan We Help told the Supervisors that this contract appears to be for "child protective services" consultation but had a very "ODD" clause on Exhibit A ( page 10 of this newly formed law firm's contract).

Shhhhh...Rancher Richard Egan hired a Deputy CAOO
Lassen County CAO Richard Egan mentioned that he had hired Tony Shaw as his "Assistant -to-the- CAO as the.... last comment before the December 16, 2014 Board of Supervisors meeting was adjourned. Julie Morgan was the "Assistant-to-the-CAO"? So what is up?
Well, it turns out that CAO Richard Egan hoped no one would notice his "slight-of-hand". Tony Shaw was actually hired as Deputy CAO and started January 5th.
Richard Egan did not have the courtesy (to the public or the Board) of placing this new County employee on the December 16, 2014 Agenda as an introduction/approval of his new "relief" CAO. Egan didn't even place this new County Employee on the January 13, 2014 Agenda. This was not an oversight but a deliberate attempt to hide the fact that he had hired Tony Shaw?????
