Re:  BROWN ACT VIOLATIONS, September 4, 2003

Dear LMUD Board,

KWH has just received documents (Frank Cady's LMUD invoice for Sep/03), which indicates that the Board instructed Frank Cady to take action on an injunction against KWH , on September 11, 2003. (invoice enclosed). The LMUD minutes do not indicate this action was reported to the public.

KWH has enclosed the September 4, 2003 LMUD Agenda, which indicates that the KWH Spencer vs. LMUD was placed on the closed session agenda.

KWH has enclosed the LMUD minutes reflecting the action taken in closed session. No action to file an injunction against KWH was reported to the public.

CURE and REMEDY:

There seems to be a consistent disregard for reporting action taken in closed session. This is the third known time that this Board of Directors has violated the Brown Act. There seems to be no way to impress, on this particular board, your gross disregard of the Brown Act. This LMUD Board's actions clearly indicate contempt and total disregard for the Brown Act. This LMUD's Board's actions clearly indicate that you will not, now or in the future, respect any portion of open meeting law.
