A public records request was received by LMUD on November 13, 2003 for a copy of this check. The intent of the Public Records Act is to disclose public documents. Richey and Cady were uncooperative and played the semantics game to delay records.
Richey said there were "no documents in the possession of LMUD responsive to this request". No records, no documents, nothing. Yet, this record clearly shows the amount of the PSREC payment.
It took one year to get this document, ONE YEAR. LMUD was counting on a Writ of Mandate being filed. Then it would be tied up in the courts.

PSREC customer Fred Nagel was put on the LMUD Board so that the remaining payments to LMUD would not be made. PSREC was obligated to pay LMUD payments, for the transfer of LMUD customers to PSREC, until 2010.
